Chief Building Official ATTACHMENTS: None STAFF SUMMARY Background: The building contractor submitted a building permit application for a masonry fence to be constructed using the `pouring slabs for the tilt-wall construction residential house walls which were to be cut into fence panels and placed inside C-Channels for support' I denied this based on the lack of foundation beams being constructed connecting the deep piers, per 18-210(4). Appeal: The Chief Building Official's decision to allow the construction of a masonry fence foundation using only deep foundation piers and not foundation beams. Code reference: Sec. 18-210. Masonry construction. Masonry fences must be made of brick, vitrified clay tile, concrete tile, or monolithic reinforced concrete, and must be built according to the following specifications: (1) At least eight inches thick for double-wall construction, which shall be either brick, vitrified clay tile, or concrete tile; at least six inches thick for single-wall construction, which shall be only of brick or monolithic reinforced concrete on construction. a. 1 • • (2) Pilasters shall be placed on not more than 12-foot centers, or adequate steel reinforcing shall be placed in the whole fence. (3) Expansion joints shall be placed on not more than 24-foot centers. (4) The fence shall have a foundation which shall rest on drilled footings sunk to approved bearing soil. Such footings shall be not less than 12 inches in diameter, and each footing shall have not less than four one-half-inch ties on three-foot centers. Foundation beams shall be not less than 12 inches wide and not less than 18 inches deep with not less than four five-eighths-inch reinforcing rods and three-eighths-inch ties, on not less than 30-inch centers. (5) Emergency portals may be required; see above. (Code 2003, §6.591; Ord. No. 1925, § 1(ex. A), 8-9-2010) Sec. 18-18. Appeals to BSC from administrative actions. The BSC shall hear and determine appeals from all actions of the building official, except for actions arising under the zoning ordinance (which are subject to the jurisdiction of the ZBA). In addition, the BSC shall hear and determine appeals from other administrative actions where an ordinance authorizes the BSC (or the GAB) to do so (for example, such appeals are authorized with respect to the fire official and the fire code; see chapter 30 of this Code). In any such appellate proceeding, the BSC may affirm, reverse, modify or remand the decision appealed from, and the BSC may take whatever action the building official (or other official) should have taken. (Code 2003, §6.204) Comment: I have previously approved of fencing without the foundation beam when it was in the best interest of preserving trees along Bellaire Blvd. based on the City Forester's recommendation. So providing support only at the piers is in itself not unusual. In my opinion the requirement for the foundation beam is as much for preventing rotation of the piers (allowing the fence to lean) as providing support for the masonry fence itself. A large walk gate is shown on the East side of the 2612 new house. This shall open away from the pool and be self closing and self locking not a power gate, i.e. driveway type gate, as this is not allowed as compliance to the pool barrier code. 4.
