CITY COUNCIL REGULAR SESSION
MONDAY, APRIL 10, 2000
MUNICIPAL BUILDING COUNCIL CHAMBERS

The City Council convened in Regular Session in the Municipal Building Council
Chambers on April 10, 2000, with the following members present: Mayor Lewis
presiding, Council Members Ballanfant, Bertini, Grubb and May. The City Secretary,
City Attorney and Public Works Director were also present.
The notice for this meeting was posted in accordance with the Texas Government Code,

Chapter 551, on the 7 day of April 2000 at 3:00 p.m.
Citizen Comments.
Mayor Lewis invited citizens who wished to address the City Council to come forward as
their names were called.
Elizabeth Mosny, 3706 Tangley, requested that the City replace or move the hedge where
the new sidewalk is scheduled to be installed along side her property.
Proclamation for Arbor Day.
Matters related to a Proclamation declaring and celebrating Arbor Day on April 16, 2000.
A motion was made by Council Member Ballanfant, seconded by Council Member
Grubb, to approve the proclamation declaring and celebrating Arbor Day on April 16,
2000.
A vote was taken on the motion with the following result:

Ordinance relating to sidewalks.
Matters related to the second and final reading of Ordinance No. 1642.
Mayor Lewis read the caption of Ordinance No. 1642 as follows:
An ordinance relating to sidewalks; amending the code of ordinances of the City of West
University Place, Texas; and containing findings and provisions relating to the subject.

Copies of Ordinance No. 1642, in the form proposed for adoption, were available in the
Council Chambers.
City Attorney Jim Dougherty reported that Ordinance No. 1642 has been read and passed
on first reading as recommended by the Zoning and Planning Commission and members
of the City Council. The ordinance is now before the Council on second reading with the
basic idea to narrow the circumstances under which no sidewalk is required. He stated
that as he understood the Council’s direction in the Special Session, they would like to
add a curb and gutter exception and also add a 10% test for remodeling as presented in
Exhibit A-3.
A motion was made by Council Member Grubb, seconded by Council Member
Ballanfant, to adopt Ordinance No. 1642 on the second and final reading as initially read
and as amended in Exhibit A-3 and as stated by the City Attorney.

Ordinance relating to personal wireless service facilities.
Matters related to the second and final reading of Ordinance No. 1644.
Mayor Lewis read the caption of Ordinance No. 1644 as follows:
An ordinance amending the zoning ordinance of the City of West University Place, Texas
to provide for personal wireless service facilities; extending the temporary limitation
period on certain right of way permits and approvals; and containing findings and
provisions relating to the subject.
Copies of Ordinance No. 1644, in the form proposed for adoption, were available in the
Council Chambers.
Mr. Dougherty reported that Ordinance No. 1644 is the comprehensive regulation of
wireless service facilities that has been worked on for at least a year now. The joint
public hearing was held last December and the Zoning and Planning Commission has
considered the proposal and issued their final report in favor of the proposed
amendments. During the first reading of Ordinance No. 1644, there was a suggestion to
reword one of the provisions in the PWSF schedule under application No. 4. to include
not only within three miles of the site but also include within the city. The ordinance as
presented on second reading now includes this amendment.

Mr. Dougherty stated that also in Ordinance No. 1644, Section 2 is a temporary extension
of the rules for right-of-way use, which is related to this ordinance.
A motion was made by Council Member May, seconded by Council Member Grubb, to
adopt Ordinance No. 1644 on the second and final reading.

Ordinance relating to railings.
Matters related to the first reading of Ordinance No. 1645.
Mayor Lewis read the caption of Ordinance No. 1645 as follows:
An ordinance relating to railings; amending the code of ordinances of the City of West
University Place, Texas; and containing findings and provisions relating to the subject.
Copies of Ordinance No. 1645, in the form proposed for adoption, were available in the
Council Chambers.
Mr. Dougherty reported that the Building Official suggested amending Section 1015.1 of
the 1994 SBCCI Building Code by changing the requirement of a 6-inch railing to a 4-
inch railing. This change would reduce the risk of a child falling through a guardrail.
A motion was made by Council Member Bertini, seconded by Council Member May, to
adopt Ordinance No. 1645 on the first reading.

Bid award for chemicals.
Matters related to bids received March 29, 2000 for the purchase of chlorine gas, polymer
and sodium bi-sulfite.
Public Works Director Ed Menville reported that the vendors for the following chemicals
submitted the low bids:

Polymer – Fort Bend Services. Low Bid at $1.09 per pound. The estimated annual
purchase for polymer is $12,164.00.
Chlorine Gas – Acetylene Oxygen Company. Low Bid is $65.00 per 150# cylinder, $4.00
per month rental on 150# cylinder, $400.00 per One ton cylinder, $30.00 per month rental
on one ton cylinders. The estimated annual purchase for chlorine gas is $8,610.00.
Sodium Bi-Sulfite – Mid-Co Water Treatment, Inc. Only bidder - $1.28 per gallon.
Estimated annual purchase for Sodium Bi-Sulfite is $8,100.00.
A motion was made by Council Member Ballanfant, seconded by Council Member
Bertini, to approve the bids to Fort Bend Services for the purchase of polymer, to
Acetylene Oxygen Company for the purchase of chlorine gas and to Mid-CO Water
Treatment, Inc. for the purchase of sodium bi-sulfite.
A vote was taken on the motion with the following result:

City Council minutes.
Matters related to the minutes of the Special and Regular Sessions conducted on March
27, 2000.
A motion was made by Council Member Grubb, seconded by Council Member Bertini, to
approve the minutes as amended.

Council comments:
Council Member Bertini recognized the City Manager, the Fire Chief’s wife Joyce
Stevenson and Joann McCay who have been recently released or admitted to the hospital.
He asked everyone to remember them in their thoughts and prayers.
Council Member May commented that he recently served on jury duty and worked with a
great group of volunteers.

Mayor Lewis thanked the boy scouts who were attending the meeting.
Adjournment:
With no further business to come before the City Council at this time, a motion was made
by Council Member Bertini, seconded by Council Member Grubb, to adjourn. The
Regular Session adjourned at 7:50 p.m.
