Mayor Fry called the special meeting to order at 5:30 pm in the Conference Room. Council, staff and other officials in attendance were: Mayor Pro Tom Sample, Courrcrlmembers Handcuff and Yehle. Assistant City ManagegPublic Works Director Ba'rrer, City Secretary Lenz, City Attorney Petrov, and Judge Completions Elizondo. Councilmember Johnsen was Depend. At 5:31 p.m., Mayor Fry recessed the special meeting to convene into executive session per Section 551.076 of Chapter 551 of the Texas Government Code to discuss the following: 1. Assistant City Prosecutor Matters related to possible interviews of candidates, followed by discussion and consideration of par appointment of an Assistant City Prosecutor. City Council interviewed two candidates for the position. After deliberating each Candidate's qualifications and experience, Council agreed W announce the selection d one of the candidates in open session. At 6:05 p.m., Mayor Pro Tern Sample moved to close the executive session and reconvene into Open session. Councilmember Yehle seconded the motion. MOTION PASSED. Ayes: Fry, Sample, Heathcoll, Yehle Noes: None Absent: Johnsen 2. Reconvene Into Open Session Matters related to added, if any, relative to discussion held in Executive Session relating to the appointment of Me Assistant City Prosecutor. At 6:05 p.m., Mayor Fry reconvened the open session and requested a motion to appoint a candidne as the Oran Assistant Ciry Prosecutor, Councilmember Healhcoa moved to approve the opponents of Jane you to the position of Assistant Cry Prosecutor. COunoilmember Yehle seconded the motion, MOTION PASSED. Ciry Council Minutes, March 25, 2013 Ayes: Fry, Sample, Heatroott, Yehle Noes: None Absent: Johnson 3. AUlourn Special Ma ino With no further business, at 6:10 p.m., Councilmember Yele moved to adjourn the special meeting. Mayor Pro Turn Sample seconded the motion. MOTION PASSED. Ayes: Fry, Sample, Heathoott, Yehle Noes: None Absent: Johnson REGULAR MEETING (Council Chambers) Agenda items were as follows: Call to Order. Mi Fry called the meeting to order at 6:30 p.m. in the Council Chambers. Council and Staff in attendance were: Mayor Pro Tem Sample, Councilmembers Headroom, and Yehle, City Manager Foss, Assistant City Manager /Public Works Director Peifer, City Secretary Lenz, and City Attorney Petrov. Councilmember Johnson was absent. Scouts from Boy Sceud Troop 42 led the Pledge of Allegiance. Secretary Lenz confirmed that the Notice of the special and regular meetings was duly pasted in accordance with the Texas Government Code, Chapter 551. 4. Public Comments This was an opportunity for chi to speak to Council relating to agenda and non - agenda items. There were no public comments. 5. Amended Election Ordinance Matters related to amending Ordinance 1966 Calling the General Election to include Harris County Precinct 906 as a wing precinct within the City of West University Place. Ciry Secretary Lenz presented and stated that at the time the Election Ordinance was adopted, shelf was unaware that a small portion of County Precinct 87 that is within the City's boundaries is now County Precinct 906. She sand the amendment W the original ordinance is to include Precinct 906 in order for those voters within that precinct to voe in the May 2013 election without indicant. Council inquired about the need for Precinct 906 in West University Place and asked City Attorney Petrov to contact the County to ask about the purpose of it being in West University Place and whether it is possible to remove Precinct 906 so that to City can go back to having only four precincts, especially if More is Me potential for increased expenses during City elections. City Attorney Petrov said he will contact the County regarding this issue and will inform Council of his findings. Mayor Pro Tom Sample moved to adopt an ordinance amending Ordinance 1966 on first and final reading. Councilmember Yams seconded the motion. MOTION PASSED. 2 0f4 City Council Minutes, March 25, 2013 Ayes: Fry, Sample, Heathaob, Yehle Nova: None Absent: Johnson 6. Desianatng Official Newspaper Matters related to designating the City's official newspaper including adoption of an confidence. City Secretary Lenz presented and stated that Houston Community Newspapers (HCN) has been the city's official newspaper for legal notices and advertisements since December 2011. She said HCN recently contacted her to give notice that the contract had expired and the City would begin paying higher prices for its published notices. Therefore, the City solicited Request for Proposals an in order M continue receiving a competitive rate. City Secretary Lenz said that in order to continue receiving a competitive rate for the publication of legal notices, staff solicited Request for Proposals from several newspaper entities. She saitl HCN was the sole responder and that she is satisfied with the proposed rates. She also said HCN complies with the requirements to serve as the Ciys official newspaper and recommend that Council award the contract to HCN. Councilmember Yehle moved to approve the commence designating the West U Examiner (HCN) as the official newspaper for the City until such time the City again seeks competitive bids, Councilmember HeaMCOff seconded the motion. MOTION PASSED. Ayes: Fry, Sample, Heathcod, Yehle Noes: None Absent: Johnson T. Colonial Park Cornmeaonalre Matters related to a contract for Colonial Park Concessionaire. Parks antl Recreation Director O'Connor presented this item and stated that E.I. Thomas, owner of Educe Cafe and Deli, Informed staff that he would not be able to continue the third year of the potential three-year contract with the City as concessionaire at Colonial Park Pont. Mr. O'Connor said stag solicited proposals from businesses that were interested during the previous solicitation of bids - Skeeter's, Prince's Hamburgers, Firehouse Subs, Chick -FII-A am Edloe Cafe and Deli, but said there were insurmountable limitations with corporate policies andlor other reasons for four of the five establishments, so only Prince's submitted a proposal. He said after review of Me proposal, he believes Prince's Hamburgers will be an excellent sooner in terms of quality, services and pricing. Mr. O'Connor said Me term of the contract will be for a one -year period with the opllon to renew annual for two additional seasons provided both Series are in agreement. He said there are a couple of significant changes, including going with a flat fee rather than a percentage and Me City retaining ownership of the equipment. Councilmember Yehle asked "From a health code perspective, since there is no official kitchen at that location, would it be the concessionaire's problem or would the City have a role in it now Mat it's the Ciys equipmeni Mr. O'Connor responded that it will be up to the concessionaire to coordinate all the required inspections, etc. He saitl the concessionaire will also be responsible for maintenance of the equipment. 3 of City Council Minutes, March 25, 2013 Councilmember Yehle moved to recognize Prince's Hamburgers as the Colonial Park Concessionaire and euMOrize the City Manager to execute a contract between the City and Prince's Hamburgers. Consent A mnda All Consent Agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a Council member requests in which event the item will be removed from the Consent Agenda and considered in hs normal sequence on the agenda. Councilmember Yehle reminded everyone about the Concert Series, beginning the first three Fridays in April. 10.
