CITY COUNCIL MEETING MINUTES
The City Council of the City of West University Place, Texas, met in workshop and regular sessions on
Monday, March 11, 2013, in the Municipal Building, 3800 University, West University Place, Texas
beginning at 6:00 p.m.
SPECIAL MEETINGM/ORKSHOP (Conference Room)
Call to Order. Mayor Fry call" the workshop to order at 6:00 pm in the Conference Room. Council
and Staff in attendance were: Mayor Pro Tem Sample, Councintembers Heathcoh, Johnson and
Yeble, Assistant City Manager /Public Works Director Peter, City Secretary Lenz, and CM Attorney
Petrov.
At 6:00 p.m., Mayor Fry deceased the workshop to convene into executive session per Sections
551.074, 551.071 and 551.072 e1 Chapter 551 of the Texas Government Code. Items discussed were
as follows:
1. Asslstand City Prosecutor
Matters related to the discussion and consideration W appointment of an Assistant City Prosecutor.
This item was discussed in closed session in accordance with Section 551.074 of Chapter 551 of the
Texas Government Code (Deliberation concerning an employee).
2. Parks AeoulsHlon
Matters related to the discussion of the value or transfer of real property and other real estate related
to Path acquisition.
This item was discussed in closed session in accordance with Sections 551.072 (Delibem6on on
matters related to the value or transfer of real property and most real estate) and 551.071
(Consultation with City Attorney on matters) of Chapter 551 of the Texas Government Code.
3. Reconvene Into Open Session
At 6:29 p.m., Mayor Pro Tern Sample moved to close me executive session and reconvene the
workshop. Councilmember Johnson seconded the motion. MOTION PASSED.

At 6:29 p.m., Councilmember Yehle moved to adjourn the workshop. Councilmember Johnson
amended the motion. MOTION PASSED.

REGULAR MEETING (Council Chambei
Agenda items were as follows:
Call to Order. Mayor Fry called the meeting to order at 6:30 p.m. in the Council Chambers. Council
and Stan in attendance were: Mayor Pro Tern Sample, Councilmembers Heathcon, Johnson and
Yehle, CM Manager Ross, Assistant City Manager Public Works Director Forks, City Secretary Lenz,
and City Attorney Petrov.
Bay Scouts from Troops 266 and 740 led the Pledge of Allegiance.
Secretary Lenz confirmed that the Notice of the special and regular meetings was duly posted in
accordance with the Texas Government Code, Chapter 551.
5. Public Comments'
This was an opportunity for citizens to speak to Council relating to agenda and non - agenda gems.
No one signed up to speak, but before the regular meeting adjourned for the evening, Jessica
Breltbell, 3626 Pittsburg Street, spoke W say that she was not aware of the process to sign up to
speak, but wanted an opportunity to speak, which the Mayor granted.
Ms. Beanbag said she came before City Council to speak for herself and on behalf of a sizeable
portion of her neighbors on Pittsburg Street and the 6400 and 6500 blocks of Mercer Street. She said
it is their understanding that City Council is still considering the purchase of property on Mercer
Street, as wall as the Ownby propeM, for the purpose of creating a park and they want Council W
know that they are against a proposed park. She said they have trepidation about going forward and
are very much opposed and are concerned about crime, parking, litter, lighting, traffic and more.
Mayor Fry said this cant be discussed as R is not an agenda Rem, but said nothing will be done on
this issue until the community has been brought up to date and public hearings are held He said if
and when the time comes, residents surrounding the park will be fully involved in the process.
6. Arbor Day Proclamation
Matters related to a Proclamation designating March 23, 2013 as Artier Day in the City of West
University Place.
Councilmember Joan Johnson read the proclamation and, on behalf of Mayor Fry, proclaimed March
23, 2013 as Arbor Day in the City of West University Place.
City Planner Scarcella reminded everyone that the City is having its Ador Day festivities in
conjunction with the Spring Fling (formerly known as the Eggstravaganza) at 9:00 a.m. on March 23,
2013 and approximately 30 trees will be given to the first residents that arrive M event.

Z. Request for Zoning Public Hearina
Matters related to a request to hold a public hearing to hear comments for or against and an
ordinance amending the Code of Ordinances to clarify the definitions of a 'dwelling"; 'accessory
quarters and uses ".
City Planner Scamzlla presented and said this item, along with the next two items, is to request public
hearings, which were all first brought to the attention of Me Zoning and Planning Commission (ZPC)
by Scam in order to clarify a few issues.
In regards to this hem, W. Scarcella said that this public hearing will be to hear comments for or
against changing the densities of Accessory Quarters because the current ordinance states that a
Single - Family District allows only a single - family residence and one Accessory Quarter and Staff
Interprets the zoning ordinance to read that the Accessory Quarters must be attached to the primary
dwelling or be contained within the primary dwelling. She said with the way the current ordinances
reads, there are soma detached garages with dwellings above them that Can no longer be remodeled
or restored because there is a provisional ordinance that states the Building Official cannot issue a
permit g the site does not conform to the zoning regulations. Yet, with an attached garage, the same
type of configuration would be allowed because it is considered to be contained within the principal
dwelling.
Ms. Scarcella noted that in adds ion to changing the definition of Accessory Quarters, the public
hearing will also be to hear comments for or against the proposal to change Me definition of
accessory and Single Family Use, to make clear what type of lawful accessory uses are permitted In
a single - family district, and to Change the definition of dwelling.
Ms. Scarcella said the Zoning and Planning Commission recommends that both attached and
detached structures be treated equally, as well as guest quarters, etc., and these proposed changes
To the Cotle will do that.
Mayor Fry noted that the ordinances brought forth for these items tonight are to only cell for the public
hearings and that these issues will be discussed in full derail and comments heard during the public
hearings. However, he wanted Staff to make a brief Comment so that Me public would know that the
hearings are forthcoming for discussion In a public meeting.
Ms. Scarcella said Staff recommends that Council call for a public hearing with the Zoning and
Planning Commission to hear the proposal on ApM 8, 2013.
Councilmember Johnsen moved to schedule a public hearing for April 8, 2013 to clergy dwelling and
auxiliary dwellings. Mayor Pro Tom Sample seconded the motion. MOTION PASSED.

8. Neediest for Zoning Public Hearing
Matters related to a request to hold a public hearing to hear comments for or against and an
ordinance amending to Code of Ordinance relating to tlriveways in the front yard, curb cuts in the
righW -way, and non - Single Family District parking space con igundon.
Councilmember Yehle moved to approve an ordinance calling a joint public hearing on April 8, 2013,
on to proposal to amen the Zoning Ordinance with regard to the driveways in the front yard and
number of curb cuts In the public right -of -way. Mayor Pro Tern Sample seconded the motion.
MOTION PASSED.

9. Reouest for Zoning Public Hearing
Matters related to a request to hold a public hearing to hear comments for or against and an
ordinance amending the Code of Chaparral relating to thmugh-lots.
Councilmember Yanks moved to approve an ordinance calling the joint public hearing on April 8.
2013, on the proposal to amend the Zoning Ordinance with regards to the definition of building sres
and locatlg0 of fences. Councilmember Heathcott seconded the motion.
Councilmember Yorks sad he attended several of the hearings of the ZPC as all of these issues were
being considered and Council should be aware that ZPC has given It a IM of thought to removing
anomalies and creating new eminences that will Serve the community areall.
10. Consent Agenda
All Consent Agenda items listed are considered to be routine by the Cry Council and will be enacted
by one motion. There will be no separate discussion of these Rome unless a Council member
requests in which event to hem will be removed from Me Consent Agenda and considered in as
normal sequence on the agenda.

Matters related to an ordinance approving revisions to the Code of Ordinances granting
pul onary to Stag to waive a late fee for utility bills.
City Secretary Lenz stated that Item A Should mad that Council is being asked to approve the
Minutes of March 11, 2013, not February 11, 2013 as listed.
Councilmember Johnson moved to approve the Consent Agenda with the change to the Minutes
date. Councilmember Heathcott seconded the motion.
