September 9, 2010

Call to Order — With quorum present at 6:15 p.m., Steve Brown called the meeting to
order.
1. Notices, Rules, Etc. ZPC and staff introduced themselves. Debbie Scarcella
informed ZPC that BSC did not meet in September regarding Basements.
2. Minutes.
August 12, 2010. Sam Parikh made a motion to approve the minutes as
revised. Motion was seconded by Lauren Griffith. Ayes: Steve Brown, Dick Yehle,
Sam Parikh, DeDe DeStefano and Lauren Griffith. Abstain: Bob Higley. Noes:
none. Minutes approved.
3. PNC Status and Parking Regulations. Staff presented corrections and additions
including a draft preliminary report and ordinance amending the zoning regulations
regarding both the PNC Status and Parking Regulations items. The ZPC reviewed the
proposed amendment corrections and made suggestions to clarify wording. After
discussion with the city attorney during the workshop, the ZPC instructed staff to
revise the draft ordinance and attached hearing notice to reflect the new hearing
procedure. The ZPC then discussed at length the ramifications of the proposal on the
Kirby properties and expressed concern that the proposal would "lock in" the existing
uses with no incentives to change the uses in the foreseeable future. ZPC expressed
the thought that this was not within the scope and general purpose of the section
regulating PNC status. A suggestion was made that staff investigate the possibility of
including some of these concerns in the preliminary report with the strong
recommendation that council consider resolution of the situation either through a
comprehensive study of the commercial regulations or some type of initiative to study
the possibility of rezoning the remaining nonconforming Kirby properties. The ZPC
asked staff to redraft the preliminary report incorporating these points and make the

suggested corrections and bring back for consideration at the next meeting in
October.

Adjournment. Lauren Griffith made a motion to adjourn. De De DeStefano
seconded. Ayes: Steve Brown, Sam Parikh, Bob Higley, Lauren Griffith and De De
DeStefano. Motion passed. Meeting adjourned at 7:50 p.m.
