Lenz, City Legal Counsel; John Brown, Building Official and Sallye A. Clark, Planning Assistant Call to Order — With quorum present at 6:21 p.m., Steve Brown called the meeting to order. Bryant Slimp also called the BSC meeting to order with a quorum present. 1. Notices, Rules, Etc. ZPC, BSC and staff introduced themselves. Bruce Frankel announced that the Town Center Ad Hoc Committee report is scheduled for presentation at the January 24, 2011 City Council meeting and encouraged ZPC members to attend. The council agenda has not been set and ZPC requested staff to email ZPC members when a time is confirmed. 2. Minutes of the December 9, 2010 regular meeting. Bob Higley made a motion to approve the minutes as amended. Motion was seconded by Bruce Frankel. Ayes: Steve Brown, Bruce Frankel, Bob Higley, DeDe DeStefano, Lauren Griffith and Sam Parikh. Noes: none. Minutes approved. 3. Basements. Members of the Building and Standards Commission met in a joint session with the Zoning and Planning Commission to discuss finalizing the proposed amendment prohibiting basements. Staff presented the amended proposal as discussed by the Building and Standards Commission at their meeting held on January 6, 2011. Members from both the BSC and ZPC discussed removing the provision for a special exception that would allow a basement under limited conditions (100 sf, for mechanical and wine cellars only, additional engineering data). A straw vote was taken by each commission separately, with the majority in favor of removing the special exception provision. Bob Higley made a motion to approve the amendment as reworded: {Change Exhibit "A" to Appendix "A"; 3800 University Boulevard • West University Place, Texas 77005-2899 • 713.668.4441 • www.westu.org Page 2 Amend Code of Ordinances, Chapter 18 by adding a new section 18-67, entitled "Basements Prohibited" as follows: Sectio 8-67. Basements, a) Basements Prohibited. The construction of a basement dential purposes is prohibited.) Bruce Frankel seconded. Ayes: Bob Higley, Steve Brown, Sam Parikh, Lauren Griffith and DeDe De Stefano. Noes: Bruce Frankel. Absent: Dick Yehle. Motion passed. BSC Members then took a vote. Ed Heathcott did not vote. Dave Flame made a motion to approve the proposal as reworded by ZPC. Frank Griffin seconded. Ayes: Bryant Slimp, Thomas Kearns, Dave Flame and Frank Griffin. Noes: Laurinda Lankford. Motion passed. BSC requested John Brown, Building official compose a staff memo to City Council to cover the actions taken from July 2010 to present. ZPC requested that John Brown forward the memo to ZPC members when completed. Laurinda Lankford made a motion to adjourn the BSC meeting. Dave Flame seconded. Ayes: Bryant Slimp, Thomas Frank, Dave Flame and Frank Griffin and Laurinda Lankford. Noes: none. Motion passed. Meeting adjourned at 7:36 p.m. and BSC members were dismissed. Staff will prepare the amendment and forward to City Council for consideration. 4. PNC Status and Parking Regulations. Steve Brown asked if any members of the audience wished to make any additional comments regarding the proposed amendments. There were no members of the audience wishing to speak. Sam Parikh made a motion to close the ZPC portion of the joint public hearing from January 10, 2011. Bruce Frankel seconded. Ayes: Steve Brown, Bruce Frankel, Bob Higley, DeDe DeStefano, Lauren Griffith and Sam Parikh. Noes: none. Motion passed. Staff presented a draft final report. The ZPC asked staff to add the word "certain" under "Scope of Proposal" in the third item between the words "for" and "food". Additionally, staff was instructed to incorporate a sentence denoting the close of the public hearing into the final report. De De DeStefano made a motion to forward the final report and proposed ordinance as amended to City Council for consideration. Lauren Griffith seconded. Ayes: Steve Brown, Bruce Frankel, Bob Higley, DeDe DeStefano, Lauren Griffith and Sam Parikh. Noes: none. Absent: Dick Yehle. Motion passed. 5. Executive Session (if necessary). Not used Adjournment. DeDe DeStefano made a motion to adjourn. Lauren Griffith seconded. Ayes: Steve Brown, Bruce Frankel, Bob Higley, DeDe DeStefano, Lauren Griffith and Sam Parikh. Noes: none. Motion passed.
