MAKING THIS ORDII.'IANCE APPLICABLE TO PRIVATE Al\1]) PUBLIC PROPERTIES; PROVIDING A SAVINGS CLAUSE AI\1]) A PENALTY FOR VIOLATION HEREOF; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREVIfITH AND ES- TABLISHING AN EFFECTIVE DATE. *******~*********** BE IT ORDAINED BY THE CITY CO:MMISSION OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: I The City Commission recognizes and declares an emergency to exist by reason of the number of fires started by individuals who light fires in positions or at points where such fires spread easily and quickly without proper control, thereby endangering the buildings and properties of other individuals and the lives of the firemen of the Fire Department of the City and the lives of citi- zens who volunteer their assistance under such circumstances, and consider it imperative that this ordinance take effect at the earliest possible date. II From and after the effective date of this ordinance, it snall be unlawful for any'person or persons to light or start any fire in any open sp~ce or on any vacant lot or part of a lot or tract of land within the city limits of the City of West Univer- sity Place without having first applied for and secured the written perm~ssion and consent of the Fire Chief of the Fire Department of the City of West University Place, Texas. III That the provisions of this ordinance prohibiting the start- ing of any fire as provided in Paragraph II above shall apply to the lighting or starting of a fire with or in any rubbish, trash, shrubbery, tree cuttings, growing grass, growing weeds, dead grass or weed~ or any other inflammable substance which may be on, or hereafter placed upon, any open or vacant lot~ tract, or __part of a lot or tract of property ,wi thin the city- limits of the City of West University Place. IV - --, i That the provlslons of this ordinance shall apply whether any fire governed hereby be started or lighted on the private property of an individual or upon the pUblic prop~rty or prop- erties of the City or any other Governmental unit. - 1:.l. . - "!r . i:It1l! .1I[JJ:lI.; , IT [:,1 .: L., .:1 ~4 v \ I If any part or parts of this ordinanee shall for any reason be invalid, such invalidity shall not in anyr;manner effect the ,:1 valid parts hereof. i I VI - Any person or persons who shall violate any provision or part of this ordinance shall be guilty of a misdemeanor and upon conviction, shall be fined in any sum not to exceed One'Hundred Dollars ($100.00). VII All ordinances or parts of ordinances in conflict herewith or any part of. this ordinance are hereby repealedinsefar as such. conflicts exist only. VIII This ordinance shall be effective from and after the publi- . cation of its caption as provided by the City charter.
