' , :.. 71~c:::--::: I::;;;Ll - -~-~ ---- -~~~ 0,,8 ORDINANCE NUMBER 1345 -1 ~ AN ORDINANCE RELATING TO PERSONNEL MATTERS; ADOPTING A PERSONNEL MANUAL; REPEALING PORTIONS OF THE CODE OF ORDINANCES OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS; AND CONTAINING FINDINGS AND PROVISIONS RELATING TO THE SUBJECT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Section 1. That the City hereby approves and adopts a new personnel manual, which manual is entitled "PERSONNEL POLICIES AND PROCEDURES, II dated May 1, 1989, and on fil e in the offi ce of the City Secretary. Articles VII (Discipline) and VIII (Grievances) of Chapter 2 of the Code of Ordinances of the City of West University Place, Texas, are hereby repealed, subject to the other provisions of this ordinance. Sectionl. Said new personnel manual shall supercede and replace the comparable provisions of all prior personnel ,policies and procedures heretofore adopted by the City Council or by any officer or agency of the City. Specifically, such new personnel manual shall ! replace the two articles in the Code of Ordinances repealed as provided i in Section 1, above. ~ Section 3. The discipline and grievance procedures specified in the new personnel manual shall apply to all disciplinary and grievance proceedings commenced after the effective date of this ordinance. A proceeding is commenced when a formal notice of the proceeding is delivered to the person subject to the discipline, in the case of disciplinary action, or when the officer who is to act first on a grievance receives written notice of the grievance with a request that it be acted upon under the City's grievance procedures. The prior procedures shall apply to proceedings commenced on or before the effective date of this ordinance, and such prior procedures are continued in effect for this purpose. Section 4. The grounds for discipline specified in the new Article VII shall apply to conduct occurring after the effective date of this ordinance, and the prior policies shall apply to conduct occurring on or before the effective date of this ordinance. Such prior policies are continued in effect for such purpose. Section 5. Except as provided above, all provisions of the new personnel manual shall apply for all purposes from and after the effective date of this ordinance. Sectiun 6. Nothing in this ordinance shall ever be construed as creating any contractual or vested rights of any kind. The City Council shall have the continuing right to repeal and to amend this ~ Ordinance Number 1345 07~J m ordinance and said new personnel manual at any time. and the City Council does not purport to surrender or abrogate any of its legislative or regulatory jurisdiction. Section 9. The City Council officially finds. determines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this. ordinance was discussed, considered or acted upon was given in the manner required by the Open Meetings Law. TEX. REV. CIV. STAT. ANN. art. 6252-17. as. amended, and that each such meeting has been open to the public as required by law at all times during such discussion. consideration and action. The City Council ratifies, approves and confirms such notices and the contents and posting thereof. Section 10. This ordinance shall become effective May 1, 1989.
