CITY COUNCIL MEETING MINUTES
The City Council of the City of West University Place, Texas, met in special session on Monday, May
16, 2011, in the Municipal Building Council Chambers, 3800 University Boulevard, West University
Place, Texas beginning at 5:00 p.m.
CALL TO ORDER
Mayor Kelly called the meeting to order at 5:05 p.m. Council and staff in attendance were: Mayor Pro
Tem Fry, Councilmembers Guffey and Segal, City Manager Ross, City Secretary Lenz, City Attorney
Petrov, and Assistant City Manager/Public Works Director Peifer. Councilmember Boehme arrived at
5:06 p.m.
City Secretary Lenz confirmed that the Notice of the special meeting was duly posted in accordance
with the Texas Government Code, Chapter 551.
Agenda items were as follows:
1. Public Hearing on Temporary Moratorium Affecting Residential Development
Matters related to a public hearing to hear comments for and against a proposed moratorium on
property development in accordance with the requirements of Chapter 212, Subchapter E, of the
Texas Local Government Code, on platted lots within the City that do not abut constructed streets.
City Manager Ross provided background information. He said the width of the subject area for this
agenda item is between Mercer Street and Poor Farm Ditch and runs from University Boulevard
down to Holcombe Boulevard.
Mr. Ross said there are approximately 16 large potential parcels of land, which could theoretically
be developed into 32 single-family lots, depending on interpretation. He said due to such situations
being concentrated in one area, future development may result in an effective doubling of density
and may potentially become burdensome upon existing infrastructure, specifically essential public
facilities.
Mr. Ross said the area already has traffic congestion concerns with a day school in the area and
with Mercer Street being a north/south street that runs from Bissonnet to Holcombe. He said with
the increase in the impervious area, this could create a demand beyond the existing design for the
essential public drainage facilities; and, in addition, demands upon the water distribution and the
sewer collection systems could require additional capacities and expansion to the existing and
essential public utility facilities.

Mr. Ross said, lastly, development along a nonexistent and undeveloped street creates questions
and challenges for access by public safety responders and also creates the additional challenge of
the location of additional fire hydrants as part of the essential component of public safety facilities to
serve these potential developed back lots that do not exist in the present system.
This concluded Mr. Ross' points for the record.
At 5:08 p.m. Mayor Kelly opened the public hearing to hear comments regarding this agenda item.
With no comments from the public, Councilmember Segal commented that he doesn't see how
anyone from the public could have had an opportunity to know what the public hearing was about,
so it's not surprising that no one is here to address this in a public hearing.
With no other comments, Mayor Pro Tem Fry moved to close the public hearing at 5:09 p.m.
Councilmember Boehme seconded the motion. MOTION PASSED.

With no further business before the Council, at 5:09 p.m., Mayor Pro Tem Fry moved to adjourn the
regular meeting. Councilmember Boehme seconded the motion. MOTION PASSED.
