HomeMy WebLinkAbout041111R CC MinThe City of West University Place A Neighborhood City CITY COUNCIL Bob Kelly, Mayor Bob Pry, Councilmember George Boehme, Councilmember Steven Segal, Councilmember Chuck Guffey, Councilmember STAFF Michael Ross, City Manager Alan Petrov, City Attorney Thelma Lenz, City Secretary CITY COUNCIL MEETING MINUTES The City Council of the City of West University Place, Texas, met in special and regular sessions on Monday, April 11, 2011, in the Municipal Building, 3800 University Boulevard, West University Place, Texas beginning at 6:00 p.m. SPECIAL WORKSHOP (BEGINNING AT 6:00 IN THE CONFERENCE ROOM) CALL TO ORDER Mayor Kelly called the meeting to order at 6:00 p.m. Council and staff in attendance were: Mayor Pro Tern Fry, Councilmembers Boehme, Segal, and Guffey, City Manager Ross, City Secretary Lenz (arrived at 6:05 p.m.), City Attorney Petrov (arrived at 6:10 p.m.), and Police Chief Ken Walker. Agenda items were discussed as follows: Solicitor's Ordinance Matters related to the City's solicitor's ordinance, including discussion on how to enforce the current ordinance, including the current fines, penalties, and other deterrence which could help prevent unauthorized solicitations. Councilmember Boehme, with a second by Councilmember Segal, requested that this item be placed on the agenda. Councilmember Boehme said he would like the City to get as strict as it legally can and asked the City Manager to look into what other cities are doing. He said, if possible, he would like for us to require solicitors to wear orange vests or some other significant color. When asked about stats, Chief Walker responded that 7 applications were received in 2010 of which 2 were approved and the 4 have been received so far this year of which none were approved. As for arrests, 0 people were arrested in 2009, 3 in 2010, and 3 so far this year. Mayor Pro Tern Fry asked if there are adequate tools to enforce the current ordinance. Chief Walker responded yes. Councilmember Segal said he would like to see a blurb about solicitors and solicitation in the next issue of City Currents. City Council Minutes, April 11, 2011 City Attorney Petrov said we will look at our options regarding solicitation, but noted, and wanted it to be clearly understood, that we will always have exempt classes of people (i.e. political and religious groups). Mayor Pro Tern Fry said to be sure Chief Walker review whatever is proposed to make sure it makes sense. At 6:25 p.m., Mayor Pro Tem moved to adjourn the special workshop. Councilmember Segal seconded the motion. MOTION PASSED. Ayes: Kelly, Fry, Boehme, Guffey, Segal Noes: None Absent: None REGULAR MEETING (BEGINNING AT 6:30 P.M. IN THE COUNCIL CHAMBERS) Mayor Kelly called the meeting to order at 6:30 p.m. All Council was present. City Manager Ross, City Secretary Lenz, City Attorney Petrov, ACM/Public Works Director Peifer, Parks and Recreation O'Connor, and Police Chief Walker were present. Boy Scout Troop 11 led the Pledge of Allegiance and Pledge to the Texas Flag. City Secretary Lenz confirmed that Notice of the special and regular meetings was duly posted in accordance with the Texas Government Code, Chapter 551. Agenda items were as follows: 2. Friends of West U Parks Donor Wall Matters related to the Donor Wall funded by the Friends of West U Parks. Mayor Pro Tern Fry moved to approve giving the Friends of West U Parks permission to install a Friends Donor Recognition Wall at the West U Recreation Center and to work with City staff to accomplish that goal. Mayor Kelly seconded the motion. Leah Ragiel, Chair of the Friends of West U Parks Fund, Inc., (FWUPF) and Steve Primose, FWUPF Board Member presented this item. Mr. Primose said over the past 20 years FWUPF has raised over $4,000,000 and FWUPF wants to pay tribute to those people that made donations and made the parks what they are today. He said FWUPF feels that the recognition wall is a professional and esteemed way to do that. Mr. Primose said the FWUPF has agreed to fund the wall, not only the initial construction, but the on-going maintenance of the wall, too; so, there will be no burden on the City. He also said they have assembled the majority of a diverse committee to make sure they capture both current and legacy donor names and to draft guidelines for the use of the wall. Mr. Primose said the wall will be constructed to match the architecture and color scheme of the Recreation Center. Page 2 of 4 City Council Minutes, April 11, 2011 Mayor Kelly asked if there will be a way to add names to the wall in case anyone is overlooked. Mr. Primose said they will do their best to include everyone upfront and will give direction to the committee to be sure the wall is built with a mechanism that will allow names to be added. Councilmember Guffey asked if recognition is based solely on financial, because there have been a lot of people who have contributed more than just money. Mr. Primose said that's a great point. He said the majority of the thinking is financial at this point, but other donors can be taken into consideration. Mayor Pro Tern Fry said other people are recognized all the time, so he doesn't think that's an issue. Ms. Riegel said Councilmember Guffey raised a great point about service donors, but she's not sure they will be able to quantify that. She said the bulk of the recognized donors will be the significant financial contributors to their events over the years. At this time a vote was made to the motion. MOTION PASSED. Ayes: Kelly, Fry, Boehme, Guffey, Segal Noes: None Absent: None 3. Public Comments This is an opportunity for citizens to speak to Council relating to agenda and non-agenda items. Dr. Carol Alvarado, 4022 Marlowe, spoke to request that pool hours be extended at the Recreation Center, at least for the summertime. She said they are being asked to leave the swimming pool 20-30 before it actually closes. She said if she chooses not to use time by taking a shower at the facility, then she would like to be able to swim until 9:00 p.m. She also asked if there is a possibility to extend the hours until 10:00 p.m. Dr. Alvarado also spoke regarding parking on Rice Boulevard. She suggested odd/even parking so that on an odd day you park on the odd side of the street on an even day you park on the even side of the street to avoid congestion. She said there seems to be a problem getting through, particularly the 3700 block of Rice from Edloe to Auden. City Manager Ross said staff will look into it both these issues. Gale Stokes, 3746 Georgetown, said he has been a resident since 1971 and thinks that all of the Councils over the years have done a fantastic job improving the City in both its looks and the way it works. He said, however, there is one place in the City that has bothered him literally for 40 years and that is on Edloe Street between Sunset and JMH where those electrical lines have been sitting forever. He said this is both a safety issue and he suggested that Council ask staff to come up with some parameters, costs, or consequences of putting those lines underground and asked that Council look into putting that in next year's capital budget. 4. Consent Agenda All Consent Agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a Council member requests in which event the item will be removed from the Consent Agenda and considered in its normal sequence on the agenda. Matters related to a resolution adopting a Section 3 Policy in accordance with 12 U.S.C. 1701 u. Mayor Pro Tern Fry moved to approve the Consent Agenda as presented. Councilmember Segal seconded the motion. MOTION PASSED. Ayes: Kelly, Fry, Boehme, Guffey, Segal Noes: None Absent: None 5. Reports by Council/Staff There were no Council/Staff reports. 6. Adjourn With no further business before the Council, at 6:55 p.m., Councilmember Boehme moved to adjourn the regular meeting. Councilmember Segal seconded the mootion. MOTION PASSED.
