HomeMy WebLinkAboutORD 1936 Designating an Official NewspaperCity of West University Place Harris County, Texas Ordinance No. 1936 AN ORDINANCE DESIGNATING AN OFFICIAL NEWSPAPER OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS; AND CONTAINING FINDINGS AND PROVISIONS RELATING TO THE SUBJECT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Section 1. The West U Examiner, a paper having general circulation in the City of West University Place, Texas, and meeting the requirements of an official newspaper as outlined in Chapter 2051 of the Texas Government Code, is designated and declared to be the official newspaper and publication of said City. This designation remains in effect until changed by subsequent City ordinance adopted by the City Council. In connection with this designation, the City Council makes the following legislative findings and determinations: a. Chapter 2051 of the Texas Government Code only applies to some items to be published, not all items published by the City. b. When Chapter 2051 does apply, the West U Examiner substantially complies with the requirements of that Chapter, particularly in view of the following characteristics of that newspaper: (1) It is distributed weekly to virtually every home in the City (excepting only those few who request not to receive it) and to many homes in the immediate vicinity of the City. (2) In addition, it is distributed through news racks and other distribution points inside and outside the City. (3) As a practical matter, the West U Examiner is at least as good, if not better than, any other commercial paper in reaching residents of the City and other persons interested in the City's government. Section 2. All ordinances and official notices requiring publication in the official newspaper shall be published in the West U Examiner. Section 3. All ordinances and parts of ordinances in conflict with this Ordinance are repealed to the extent of the conflict only. Section 4. If any word, phrase, clause, sentence, paragraph, section or other part of this ordinance or the application thereof to any person or circumstance, shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, the remainder of this ordinance and the application of such word, phrase, clause, sentence, paragraph, section or other part of this ordinance to any other persons or circumstances shall not be affected thereby. Section 5. The City Council officially finds, determines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this ordinance was discussed, considered or acted upon was given in the manner required by the Open Meetings Law, Chapter 551, Texas Government Code, as amended, and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action. The City Council ratifies, approves and confirms such notices and the contents and posting thereof. Section 6. This ordinance shall become effective upon adoption and signature.
