HomeMy WebLinkAbout07091986 ZBA MinutesSPECIAL .MEETING ZONING BOARD OF ADJUSTMENT JULY 9, 1986 The Zoning Board of Adjustment of the City of West University Place convened in special session at the City Hall on Wednesday, July 9, 1986 at 7:30 p.m. with the following members present: Chairperson Billings, presiding; members Opal McKelvey, John Maloney, Sterling Minor, Robert Crain; alternate members Robert Heaton, Doris J. Marshall and Ralph McNeir. Chairperson Billings ascertained that Notice of Meeting had been posted in ~' the City .Hall on July 3, 1986 and Notice to Interested Property Owners mailed on June 27, 1986. He also introduced himself and gave his address in the City followed by other members of the Board and administered the oath to all those present wishing to speak. Motion was made, seconded and carried, to open Public Hearing to reconsider application docketed no. 86-4 from Thvong Van and Bao T. Phan to build a house on a 50 ft. by 95 ft. lot at 4122 Bissonnet Lot 17, Block 3 College Court Addition David G. Allums, attorney for the applicants, presented the Board with a petition for rehearing of building permit denial and a County plat from 1940 showing the application of the 5 ft. right-of-way to all adjacent lots to Lot 17, Block 3, for right-of-way road purposes. Mr. Allums re- viewed extensively the applicants petition to construct a single-family residence on said lot. Chairperson Billings requested that the petition for rehearing of the building permit denial and the County plat be made a part of the record of this hearing. Following a short recess, the Board reconvened. Chairperson Billings ascertained from Chief Building Inspector, Wayne E. Perry, that the building plans met all requirements of the building code of the City of West University Place. Those wishing to speak in support of Mr. Phan's application were given the opportunity to do so. There were none in support of the application. 243 Chairperson Billings requested that all correspondence in favor of the application be made part of this reharing application docketed no. 86-4: "I am writing in reference to appeal number 86-4. It is my observation that most all of the lots in that block of Bissonnet are presently under- sized lots. All but one other lot besides the one in question has a house on the property. In my opinion, I cannot understand why a permit would be denied. As a close resident, I would not want a vacant, unde- sirable piece of property close to mine. Thank you for your time and consideration. Sincerely, Charles T. McBride June 2, 1986" 244 "We do not object to the building of a house on the undersized lot. We do have problems with standing water and at times, flooding in our back yards whenever there is a heavy rain because the water has nowhere to drain. If a house is to be built on the lot it should have rain gutters on the roof with downspouts running directly to- wards the city sewerage system to avoid excess rainwater draining into neighbor's yards. Also, if additional fill is to be used to raise the elevation of the land the excess drainage will cause flooding of the neighbor's yards and this problem must be addressed so this will not create a problem in the future. We appreciate being able to submit our views since we are unable to attend the Public Hearing. We are confident all matters will be handled in the best interest of our city and its residents. Perry, stated that the permit was denied because the lot is undersized and does not meet the minimum requirements of 5,000 square feet. Following determination by Chairperson Billings that there were no others desiring to oppose the application and no other correspondence opposing the application, motion made, seconded and carried, that Public Hearing to reconsider application docketed no. 86-4 be closed. Following a short recess, the meeting reconvened. Following a discussion by Board members a motion was made by Mr. Minor, seconded by Mr. Maloney, that application docketed no. 86-4 from Thvong Van Phan to construct a residence on a 50 ft. by 95 ft. lot described as Lot 17, Block. 3 College Court Addition 4122 Bissonnet be granted on basis that in .the event said lot is less than 5,000 square feet, but is 4,700 or more square feet in area, the Board grants a special exception under Appendix A. Sec. 30(b)(6) of the Zoning Ordinances of the City of West University Place, granting for such lot a modification of the area requirement for construction of a single-family dwelling on such lot.
