J rl ~l REGULAR MEETING ZONING BOARD OF ADJUSTMENT JUNE 19, 1986 239 The Zoning Board of Adjustment of the City of West University Place, Texas convened in regular session at City Hall, 3800 University Boulevard, Houston, Texas 77005 on Thursday, June 19, 1986 at 7:30 p.m. with the following members present: Chairperson Billings, presiding; members Opal McKelvey, Sterling Minor, Robert Crain; alternate members John Pickul, Ralph McNeir and Doris Marshall. Mr. Pickul was designated to sit in the absence of member John H. Maloney. Assistant Building Inspector, D.B. Gordon, was also present. Chairperson Billings ascertained that Notice of Meeting had been posted at the City Hall on June 16, 1986; Notice of Public Hearing published in The Houston Chronicle on June 2, 1986 and Notice to Interested Property Owners mailed on May 30, 1986. Chairperson Billings introduced himself and gave his address in the City, followed by other members of the Board and administered the oath to all those present desiring to speak. Motion was made, seconded and carried, to open Public Hearing to consider appli- cation docketed no. 86-4 from Thvong Van and Bao T. Phan to build a house on a 50 ft. by 95 ft. lot located on: Lot 17 Block 3 College Court Addition 4122 Bissonnet Mr. Phan stated to the Board that he had purchased given a survey showing the lot to be 50 ft. by 100 architect to produce plans for his new home he had results of this second survey showed the lot to be east 5 ft. of said lot was granted to the County o of-way for street purposes. the lot la years ago and was ft. The 50 ft. by 95 ft.; the south- E Harris as a perpetual right- During questioning and discussion with Mr. Phan., Chairperson Billings requested Mr. Phan to submit a set of plans for the Board to review. Following a short recess, Mr. Phan returned with the plans and the meeting recon- vened. It was determined upon review of the site plans that Mr. Phan had the original site plans, not the revised and corrected plans checked by the City's plan checker. Board members reviewed the plans discussing the lot coverage and the effect of drainage when building on an undersized lot. Those wishing to speak in support of Mr. Phan's application were given the oppor- tunity to do so. There were none in support of the application. Chairperson Billings read the .following correspondence received in favor to the application docketed no. 86-4: 240 "I am writing in reference to appeal number 86-4. It is my observation that most all of the lots in that block of Bissonnet are presently undersized lots. All but one other lot besides the one in question has a house on the property. In my opinion, I cannot understand why a permit would be denied. As a close resi- dent, I would not want a vacant, undesirable piece of property close to mine. Thank you for your time and consideration. Sincerely, Charles T. McBride June 2, 1986" "We do not object to the building oc a house on the undersized lot. We do have problems with standing water and at times, flooding, in our back yards whenever there is a heavy rain because the water has nowhere to drain. If a house is to be built on the lot it should have rain gutters on the roof with downspourts running directly to- wards the city sewerage system to avoid excess rainwater draining into neighbor's yards. Also, if additional fill is to be used to raise the elevation of the land .the excess drainage will cause flooding of the neighbor's yards and this problem must be addressed so this will not create a problem in the future. We appreciate being able to submit our views since we are unable to attend the Public Hearing. We are confident all matters will be handled in the best interest of our city and its residents. Sincerely yours, Lois Walker Hatch Joe K. Wong Helen E. Wong" Speaking for the City in opposition to the application, Assistant Building In- spector, D. B. Gordon, stated that the permit was denied because the lot is undersized, 50 ft. by 95 ft., and does not meet the minimum requirement of 5,000 square feet or 50 ft. by 100 ft. Site plans submitted by Mr. Phan have met all requirements of the Building Inspections Department and have been approved. The Board questioned Inspector Gordon on the front setback and was informed that the proposed building met all setback requirements for the lot. Upon motion duly made, seconded and carried, the Public Hearing was closed. In discussion of the application, members spoke of lot coverage in terms of yard coverage with concrete as opposed to greenery or ground and what per- centage of the "open" area should be "green", knowledge of applicant of the five (5) foot right-of-way taken from the front of the lot by Harris County, concern that construction will not adversely effect drainage onto adjacent properties, and if rezoning of the less than minimum size lots would resolve problems. 241. Motion by Mrs. McKelvey, seconded by Mr. Crain, that application docketed no. 86-4 from Thvong Van Phan, to construct a residence on a 50 ft. by 95 ft. lot described as Lot 17, Blk. 3 College Court Addition 4122 Bissonnet be granted on basis that applicant has shown a hardship and on condition that construction meet all the ordinances and codes of the City as though it was 5,000 square feet. In discussion, concern was expressed that coverage of the lot with material, i.e. concrete or something other than greenery or ground, would exceed accept- albe minimums if formula for 5,000 square feet was used. Mrs. McKelvey and Mr. Crain accepted the following revision of the motion. Motion by Mrs. McKelvey, seconded by Mr. Crain, that application docketed no. 86-4 from Thvong Van Phan to construct a residence on a 50 ft. by 95 ft. lot described as Lot 17, Blk. 3 College. Court Addition 4122 Bissonnet be granted on basis that applicant has shown a hardship and on conditions that construction meet all the ordinances and codes of the City and that the lot coverage shall not be more than 60% of the 50 ft. by 95 ft. lot. Voting Aye: Billings McKelvey Crain Voting No: Minor Pickul In accordance with the Rules of Procedure of the Zoning Board of Adjustment, Article V, Section 1, "Every application shall be disallowed, unless .the con- curring vote of four (4) members of the Board shall favor the application or appeal"; therefore, the above motion failed. Minutes of the regular meeting of the Zoning Board of Adjustment on May 15, 1986 were submitted and corrections made. These minutes are to be re-submitted for approval at the next regular meeting of the Board.
