ZONING BOARD OF ADJUSTMENT
MARCH 20, 1986
The Zoning Board of Adjustment of the City of West University Place, Texas,
convened in regular session at Parish Hall, St. George Orthodox Church, 5311
Mercer Street, Houston, Texas 77005 on Thursday, March 20, 1986, 7:30 p.m.,
with the following members present: Vice-Chairperson McKelvey, presiding;
member John Maloney; alternate members Robert Heaton, Doris Marshall and
Ralph McNeir.
~' It was ascertained by the Chairperson that Notice of Meeting had been posted
,~ at the Parish Hall, St. George Orthodox Church, 5311 Mercer Street, Houston,
~y Texas, on March 17, 1986; Notice of Public Hearing published in the Houston
~1 Chronicle. on March 4, 1986; Notice To Interested Property Owners mailed on
~~ March 3, 1986. Vice-Chairperson McKelvey introduced herself and gave her
address in the City followed by other members of the Board and administered
~[ the oath to all those present desiring to speak.
Public Hearing to consider application 486-1 from Mr. and Mrs. J. A. Geash to
.reconstruct a concrete block fence located on an easement on the south side of
the property and extending into the front setback on:

was opened.
Mrs. Geash stated the wall had been in existence over 40 years and before
they bought the property; that work on the easement by City employees and/or
contractors had weakened the foundation causing deterioration and sznking of
portions of the fence; that they hired a contractor to repair fence; that
work had begun but was stopped by Building Inspector Perry who maintained
it was rebuilding, not repairing and also violation over easement.
It was ascertained during discussion and questioning of owners and Wayne
Bowman, contractor, that old fence including foundation bars were removed
and being replaced and strengthened; that approximately 23 feet out of 300
feet in violation was being repaired; that information by telephone to City
Hall was they needed no permit to repair a fence; and that it was not their
intention to violate the fence ordinance, only to maintain a wall in good
repair so as not to endanger any person on property.
Dorothy Reiger, 6516 Brompton, Mary Bucher, 2820 Bellaire Blvd. and Janet
Nolte, 2912 Bellaire Blvd., spoke in favor of the application on grounds of
preserving. old fence, safety of person and/or animals and no public interest
would be violated in allowing the fence to be constructed as originally
built. _

present south side wall which surrounds their residence at 6712 Brompton
Road, Houston, Texas 77005.
The wall has been in existance since before the Fence Ordinance.

Inspector Perry stated that the rebuilding was in violation of fence ordinance
(1) limiting extension of fence beyond main wall of house, and (2) no brick,
masonry or similar type of fence or wall shall be erected which would inter-
fere with the installation and amintenance of utility lines in the easement.
Upon motion duly made, seconded and carried, the Public Hearing was closed.
The Chairperson declared a five minute recess.
Motion made by Mr. Heaton, that an exception to allow the owner to repair
the existing wall on the south property line on

be granted on condition that owner bear the expense of removing and/or replac-
ing said wall in the future, should it be necessary for work to be performed
in the easement.
Mr. Maloney seconded the motion with the amendment that "repair" be changed
to "rebuild".
Mr. Heaton accepted the amendment.
