HomeMy WebLinkAbout02051986 ZBA Minutes2 ~ 8 SPECIAL MEETING ZONING BOARD OF ADJUSTMENT FEBRUARY 5, 1986 7:30 P.M. The Zoning Board of Adjustment of the City of West University Place convened in special session at the City Hall on Wednesday, February 5, 1986 at 7:30 p.m. with the following members present: Chairperson Billings, presiding; members Opal McKelvey, Robert Crain, John Maloney, Sterling Minor; alternate members Robert Heaton and Doris Marshall. Chief Building Inspector, Wayne E. Perry, was also present. Chairperson Billings ascertained that Notice of Meeting had been posted in the City Hall on January 31, 1986 and Notice To Interested Property Owners mailed on January 30, 1986. He also introduced himself and gave his address in the City followed by other members of the Board and administered the oath to all those present wishing to speak. Motion was made, seconded and carried, to open Public Hearing to reconsider applica- tion 485-13 from John and Janice Kling to leave and finish construction of two exten- sions on east side of house on site of pre-existing porch involving Lot 17, Block 4 Monticello Addition 2936 Albans Janice Kling presented the Board with additional information concerning the already poured foundation and installed plumbing on the proposed two story addi- tion which extends 9.6 inches into the side setback stating that to remove part of the foundation Would be detrimental to the remaining foundation and portions of the house proper foundation. She also presented a plan of the proposed lower story purportedly showing that to decrease this area the 9.6 inches waved make the space virtually useless for living area. The following letter from Charles L. Gamble, P.E. of Gamble Engineering and Asso- ciates was presenned to substantiate the statements concerning the structural as- pects of the foundation: "February 3, 1986 John Kling/Janice Kemp 2064 Augusta Houston, Texas 77057 Re: New Residence at 2936 Albans Within the City of West University Dear John and Janice: At your request, I have reviewed the plans for your recently completed con- crete foundation. The plans were prepared by Charles Ligon, Architect. Additionally, the site was inspected. 22~ Apparently the foundation is too close to the nearest property line. Should the City of West University fail to grant you relief from this setback require- ment, your contractor will face several impossible tasks. Since this addition was supported by piers, only a full excavation could re- move the piers. The extend of the required excavation is so great, it would undermine the existing residence, as well as the one next door. The perimeter grade beam would not be capable of sustaining any structural load if it became required to remove a vertical section of`the grade beam to satisfy a dimensional constraint. This particular grade beam is planned to be load-bearing for the second floor and roof framing. Should the Contractor try to remove the new slab, possible damage to the existing slab would probably result since the new slab was fully anchored into p.~ the existing foundation. ~[ As a practicing Civil-Structural Engineer, I can assure you that there will be structural problems with this particular system unless you receive relief from the authorities. Please call if you have any questions. Sincerely, Charles L. Gamble, Jr., P.E." Mr. Gamble was present and reaffirmed his statements as contained in the above letter as did also contractors on the construction. During question and discussion it was ascertained that the city has. certain standards concerning .number of feet windows in walls must be separated from property lines and/or adjoining buildings. Motion was made, seconded and carried, to close the rehearing. Board members reviewed the application discussing the various structure ramifi- cations and city ordinances contained in fire codes for windows in walls. Chairperson Billings entertained a motion that application 485-13 (rehearing) from John and Janice Kling involving Lot 17, Block 4 Monticello Addition 2936 Albans to allow encroachment into the side setback be granted on the basis that it would not be contrary to public interest and subject to (1) no further encroach- ment be made by any additional construction within the building setback other than plans already submitted; (2) that any construction meet the building code of the city as if there was a structure built on the building line of the adjoin- ing property; (3) that these conditions be made a part of the real property records by reason of these minutes. X30 Mr. Maloney moved the motion, seconded by Mr. Minor. Mrs. McKelvey offered an amendment to the motion to require that written presentation dated January 21, 1986 and February 3, 1986 be made a part of the minutes of this meeting.
