ZONING BOARD OF ADJUSTMENTS
MINUTES FROM SEPTEMBER 19, 1991
REGULAR SESSION
7:30 P.M.
The Zoning Board of Adjustment came to order at 7:30 P.M.
with Board Members Frank Billings, Robert McBride, Vic
Hansen, Sterling Minor and John Pickul present. Also
present were alternate Teresa Fogler and Sue Porreto.
Present from the City were Mike Tanner, City Manager, Whit
Johnson Mayor, Cecil Boles, Building Inspector and Susan
Thorn, Secretary. Members introduced themselves and
procedures were explained.
Sterling Minor was nominated by Frank Billings as Chairman.
All voting Aye.
Voting No: None
Frank Billings was nominated by Robert McBride, seconded by
John Pickul as Vice-Chairman.

Voting No: None
John Pickul made a motion to adopt the rules and procedures
from 1985. This motion was seconded by Robert McBride.
All Voting Aye.
Voting No: None
No residents were present to express opinions regarding any
items that were not on agenda.
The first case on the docket was #91-15, Lot 13, Block 7,
Virginia Court, 6127 Charlotte Street. Notices were read
and participants were sworn in. Louis Seade with Calli
Homes explained that he wants to move the two columns
holding carport, 2 feet to right because it is impossible to
use driveway due the narrow width. The carport roof would
not be changed, only the two columns.

Mr. Boles gave the City's viewpoint - According Section
7-100 (E II) of the Zoning Ordinance, a projection in the
side set back area is not allowed. The side set back being
three feet. A projection is not allowed under the
Ordinance.
Chris Baumann, neighbor expressed his opinion that the
carport is so narrow that even a small car could not be
backed out without difficulty.
Frank Billings made a motion to close public portion of
hearing seconded by John Pickul.
The vote was unanimous.
The second case on the Docket was 91-16, 8707 Rutgers, Lots
4 and 5, Block 41, W.U.P. lst. Notices were read and
participants were sworn in. George and Lola, owners of the
property were present.
Mr. and Mrs. Kuhn explained that want the front set back to
be 20' instead of 30'.
• Mr. Boles explained the City's viewpoint. Section 7-100 (E
II) states the front setback should be 30' instead of the
20' approved on the plans.
Kyle Pentecost of 2606 Centenary spoke in favor of the
common 20' setback.
A motion was made to close the public portion of the hearing
by Frank Billings which was seconded by John Pickul.
The vote was unanimous.
The third case on the Docket was 91-17, 6727 Weslayan, South
25' of Lot 2, Blk. 21, Collegeview. Notices were read and
participants sworn in.
Reid Friedman, Managing partner of Weslayan/6700 Ltd.
explained if this request is approved that the building is
to be built with a common roof line, no landscaping except
for a planter and with only two parking spaces.
Cecil Boles explained the City's view. Section 8-100 (5)
requires pervious areas and trees. Section 10-700 (7)
requires four parking spaces for each 1000 square feet of
gross floor area, thus the building would require 8 parking

hearing seconded by Vic Hansen and recess until 9:30 p.m..
The vote was unanimous.

The next case on the Docket was 91-18. Lots 7,8, and 9
Block 25 Collegeview. Notices were read and participants
were sworn in.
David G. Allums, attorney for adjacent residents of property
submitted a motion to abate hearing.
After a brief discussion, Frank Billings made a motion to
table the motion to abate hearing. This motion was seconded
by Robert McBride.
The vote was unanimous.
Bob Singleton presented evidence in which special exception
request had been made. This request if approved, would
authorize construction of a parking lot for use on the above
referenced lots.
Dan Bryan, agent for Intercity Property Investments
explained that the parking lot would have in excess~of
required six trees. The purpose of the parking lot would be
to provide parking for tenants and their employees.
• There would be an eight foot high fence for eastern border
and southern border. No lighting would be directed towards
surrounding residents.
Cecil Boles explained that the area is zoned as the Ruskin
Townhouse PDD (PDD-TH6). The zoning requires the Zoning
Board of Adjustments to issue a special exception for the
use of this property as a parking lot. He also explained
required setbacks.
No one spoke in favor of.
Frank Billings made a motion to recess this public hearing
until the next regularly scheduled meeting of the Zoning
Board of Adjustments, on Thursday, October 17, 1991. This
motion was seconded by John Pickul.
The last case on the docket, Docket No. 91-19 was withdrawn
by the property owner before the beginning of the meeting.
Frank Billings made a motion to reconvene meeting after a
brief break. This motion was seconded by John Pickul.

The meeting reconvened at 11:00 p.m.
After a brief discussion concerning #91-15 John Pickul made
a motion to deny the request due to the failure to shown
sufficient hardship and that any hardship imposed had been
self imposed. This motion was seconded by Robert McBride.
Motion carried unanimously.
After a brief discussion concerning #91-16, Vic Hansen made
a motion that the request be approved. This motion was
seconded by Robert McBride. Motion carried unanimously.
After a brief discussion concerning #91-17, Frank Billings
made a motion that the application be denied due to lack of
evidence on both issues. This motion was seconded by John
Pickul. Motion carried unanimously.
Frank Billings made a motion to adjourn meeting. This
motion was seconded by John Pickul. Motion carried
unanimously.
Meeting adjourned at 12:00. !
