HomeMy WebLinkAbout03071991 ZBA Minutes:~.' ~ ~ • • ZONING BOARD OF ADJUSTMENT MINUTES FROM MARCH 7, 1991 SPECIAL SESSION The Zoning Board of Adjustment meeting came to order at 7:30 P.M. with Chairman Charlie Lusk, Robert Heaton, John Pickul, and Doris Marshall present. Mr. Perry, Chief Building Official, and Elizabeth Bethune, secretary, from the city were present. Notices were read and participants were sworn in. The only case on the docket was # 91-1, 2731 Nottingham. Bo Whiteford with WDC Inc. the builder of the house on this property presented his case. Mr. Whiteford asked for a variance to allow the the garage to be left as is which is closer to the apparent property line than is allowed by the Zoning Ordinance. This property line is shown by a recent survey. There were three surveys done on the property in question, and one survey done on the neighboring property. These surveys are not absolutely conclusive as to where the property line is located. Bud Bucanon with Presley Survey, was present to explain to ~ the board that his and the other surveys did not make a conclusive determination of the property lines. Buddy Bell, 4038 Swarthmore, spoke in favor of the variance. Jamie McBride the prospective buyer of the property in question spoke in favor of the variance. Judy Glidden, 2735 Nottingham, and Attorney Pat Hancock spoke in opposition. Ms. Glidden said she was never approached in any way by the builder about the possible conflict in the property line before, during, or after construction. Mr. Perry gave the city's viewpoint: If it is determined that the property line is closer to the building than the required distance of 3', there will need to be a variance granted to leave the building in place. John Pickul made motion to close the public portion of the hearing. Doris Marshall seconded and motion carried. Motion was made to have a five minute recess and motion carried. Doris Marshall made motion to bring the meeting back to order for discussion. Robert Heaton seconded and motion • carried. After a lengthy discussion, Doris Marshall made motion to grant the variance as requested. John Pickul seconded and i~' ~ ~ • motion carried unanimously. i John Pickul made motion to adjourn and Doris Marshall seconded. Motion carried and the meeting adjourned at 10:40 P.M.
