HomeMy WebLinkAbout02211991 ZBA Minutes.' ~ ~ ~ ~ ~ s~ • ZONING BOARD OF ADJUSTMENT MINUTES FROM FEBRUARY 21, 1991 The Zoning board of Adjustment meeting came to order at 7:30 P.M. with Chairman Charlie Lusk, Sterling Minor, Robert Heaton, and Doris Marshall present. Mr. Perry, Chief Building Official, and Elizabeth Bethune, secretary, from the city were present. Notices were read and participants were sworn in. The first case on the docket was #91-1 which will be recessed until March 7th at 7:30 P.M. because of a conflict of interest. The second case on the docket was #91-2, 6425 & 6429 Virginia Court. Procedures were explained and members introduced themselves. Notices were read and participants were sworn in. Benny Puente with Benchmark Engineering, representing Michael Bates, Township Builders presented his case. John Brewer, 3612 Pittsburg spoke in opposition of the variance. Doris Marshall made motion to close the public portion of the hearing. Sterling Minor seconded and motion carried. The next case on the docket was #91-3, 6642 Sewanee. Notices were read and participants were sworn in. Benny Puente with Benchmark Engineering was present to represent this case. Mr. Puente explained that he is requesting a special exception to have the front of the property face Sewanee instead of Cason. The lot has been replatted and it is now wider on Sewanee than on Cason. Therefore, the Zoning Ordinance would require the lot to face Cason. There is an existing structure on the lot which was built prior to the replat of the lot and the front of the structure faces Sewanee. Also a variance is requested to allow the front of the house to extend over the 30 foot front setback by one-tenth of a foot, and the side setback to remain at fourteen feet, as presently constructed. • Mr. Perry Gave the city's viewpoint: . According to the ordinance, adding the footage to the lot will automatically change the frontage and they will need a special exception to front the lot on Sewanee. They will also need a variance on one-tenth of a foot on the front setback from Sewanee. Sterling Minor made motion to close the public portion of the hearing. Robert Heaton seconded and motion carried. After a lengthy discussion for 91-2, Sterling Minor made motion to deny the request to leave the front setback even with the 25' setback paralleling the existing Virginia Court right of way. Charlie Lusk, Sterling Minor, and Doris Marshall voted in favor of the motion. Robert Heaton was opposed. Discussion for 91-3 followed and Sterling Minor made motion to grant the special exception and the request for the front and side variance. Doris Marshall seconded and motion carried unanimously. Motion was made by Robert Heaton and seconded by Doris Marshall to approve the minutes. Motion carried. Motion was made by Doris Marshall and seconded by Sterling Minor to adjourn the meetinq.
