~ ZONING BOARD OF ADJUSTMENT
MINUTES FROM JUNE 18, 1992
REGULAR SESSION
7:30 P.M.
Zoning Board of Adjustments came to order at 7:30 p.m. with the
following Board Members present: Sterling Minor, Chairman, Vic
Hansen, Robert McBride and John Pickul. Present from the City were
Ed Beasley, Building Official and Susan Thorn, 5ecretary. Members
introduced themselves and procedures were explained.
No residents were present to express opinions regarding any items
that were not on agenda.
The first case on the docket was #92-07, Lots lA, 2A and 2B, Block
84, WUP lst Addition, 3617 Albans. Notices were read and
participants were sworn in.
Reed Dillon, owner of the property located at 3617 Albans explained
that he is asking for a variance to move his home over as far as
possible to the West to give the neighbors on the other side more
room between them and to place the air conditioners in the west
side setback. Since there is only a drainage easement on the west
• side the noise from the air conditioners would not disturb any
neighbors. Mr. Dillon expressed the opinion that his request can
only benefit his neighbors.
Mr. Dillon explained that he is also asking for variance on the
width of his driveway to accommodate a three car garage. He
explained that he was not aware of the ordinance limiting the width
of the driveway to 20' when he designed the home. He explained
that the entrance to the driveway is only 12' and it widens as it
reaches the house.
Teresa Fogler of 3610 Sunset spoke as a citizen in favor of Mr.
Dillon's request. She felt that the fact they are taking three
lots and building one house instead of the three houses on three
lots should be commended.
Ed Beasley, Building Official explained that an exclusive public
easement cannot be used as part of a building site. A lot with 100
feet or more requires a 10 foot side setback and it cannot be
measured using an easement as part of the lot. In referring to the
side setback calculations on page 1687 of the Zoning Ordinance a
lot of 100 feet or more the side setback distance would be "the
lesser of: (a) 7 feet, plus half of the distance by which the width
of the building side exceeds 100 feet; or (b) 10 feet", therefore
the side setback for this lot would be 10 feet not 7 feet as
• indicated on Mr. Dillon's application to the ZBA.

Mr. Beasley explained that regarding the request for a variance on
the width of the driveway, only the portion of the driveway in
front of the front setback cannot exceed 20 feet in width. He
stated that Mr. Dillon could limit the driveway to 20 feet in front
of the setback and have it widen behind the setback.
John Pickul made motion, seconded by Robert McBride to close the
public hearing portion of the meeting. Vote in favor was
unanimous.
Meeting reconvened at 8:00 p.m.
Sterling Minor explained that he did not have a problem with the
air conditioners in the side setback. Vic Hansen explained that
he felt that the building itself should go with the required
setback and the air conditioners could be allowed to encroach into
the side setback. The Board Members definitely felt that the
driveway should be limited to twenty feet as there were other
options available to Mr. Dillon in order to have the driveway
accommodate the three car garage.
John Pickul made motion to grant variance for the house to be moved
over and allow the air conditioners to encroach into the 10 feet
• side setback and to deny the variance for a driveway wider than 20
feet. Motion was seconded by Vic Hansen. Vote in favor was
unanimous.
Motion made by Robert McBride, seconded by John Pickul to approve
corrected minutes from April 16, 1992 and May 21, 1992. Vote in
favor was unanimous.
John Pickul made motion to adjourn meeting, seconded by Robert
McBride. Vote in favor was unanimous.
The meeting adjourned at 8:50 p.m.

Variance is granted to allow air conditioning units in 10 foot side
setback on the west property line. All other relief is denied.

BY THE BOARD
Unless otherwise stated, an authorization by the Board of
Adjustment for a special exception, variance or conditional use
shall expire if the applicant fails to obtain a permit within 90
days.from the date of authorization of such special exception,
variance or conditional use.
