• ZONING BOARD OF ADJUSTMENT
MINUTES FROM MARCH 10, 1992
(SPECIAL SESSION RESCHEDULED FROM 2-20-92)
The Zoning Board of Adjustment meeting came to order at 7:42 P.M.
with Chairman Sterling Minor, Vice-Chairman Frank Billings, Teresa
Fogler, Robert Mc Bride and Sue Poretto present. Ed Menville,
Director of Public Works and Alice Benson, Building Secretary were
present.
The first and only case on the docket was #92-02, 3933 Oberlin, Lot
1, Block 8, College View-First Addition. Notices were read and
participants were sworn in.
The owners of the property, Ashley and Aleena Madray requested a
variance to use the same portion of their property originally
conveyed to Harris County in the late 1940's to satisfy the city's
current side set back building requirements. In explaining their
dilemma, if the variance was denied, then the Madrays would be
forced to move their proposed home over an additional 2.5', thus
creating a 7.5' set back from the side property in lieu of the
required 5.0'. By researching this conveyance, they learned that
this particular 2.5' was allocated strictly for paving (not for
• widening) purposes along Weslayan. Most importantly, they also
found out that the conveyance was inconsistent and sporadic between
blocks along Weslayan.
Mr. Madray indicated that he has been paying taxes on a 50' x 100'
lot (not 47.5' X 100') for years and was not aware of any problem
until he submitted plans for construction. It was at that time the
survey referenced an exception to his property. Prior to deciding
to build, the Madrays unsuccessfully tried several times to sell
this property; it was only when they could not find a potential
buyer did they decide to build a new home.
Mr. Madray submitted a proposed blueline showing that the new home
would sit at the same side location as the current home. He also
gave other documentation (photographs and surveys) showing that his
new home would be consistent with all the other surrounding ,homes,
provided the variance was granted.
Vice-Chairman Billings made the motion to close the public portion
of the hearing. Robert McBride seconded the motion.
In the group discussion, Teresa Fogler felt that if the Madrays
were denied the variance then they would suffer a two fold
hardship; their lot size would be considered sub-standard (poor
resale value) and they would be denied building a home that suits
~ their needs. Chairman Minor felt it was keeping in the spirit of
the ordinance and constitutes a hardship.
Frank Billings made the motion to grant the variance with the
following exception: the Madrays could not build on or enclose the

2.5' area outside of the 47.5'property line without written
permission from Harris County. Sue Poretto seconded the motion.
The voting was unanimous.
Prior to closing the meeting, the commission approved and the
Chairman signed "an application of Lester Smith for an
interpretation of the Zoning Ordinances and related matters
regarding Docket 91-25" (Submitted by the city attorney, James
Dougherty).
Motion was made by Frank Billings to accept the minutes from
January 16, 1992. Robert McBride seconded the motion. Voting aye:
Chairman Minor, Vice-Chairman Billings, Robert McBride and Sue
Poretto. Voting no: Teresa Fogler.
Robert McBride made the motion to adjourn/the meeting at 9:38 P.M..
Teresa Fogler seconded the motion. VotiJt~ was unanimous.

The Zoning Board of Adjustments of the City of West University
Place did not meet in February, 1992 as there was no quorum
available.
