HomeMy WebLinkAbout08122010 ZPC Minutes CMI) City of Test University Place A Neighborhood City ® Recycled Paper ZONING & PLANNING COMMISSION COUNCIL CHAMBERS 3800 UNIVERSITY BOt LEVARD MEETING MINUTES August 12, 2010 MEMBERS PRESENT: Steve Brown, Dick Yehle, Sam Parikh, Bruce Frankel, and DeDe DeStefano MEMBERS ABSENT: Bob Higley and Lauren Griffith COUNCIL: none STAFF PRESENT: Debbie Scarcella, City Planner; Chris Peifer, Assistant City Manager/Public Works Director; Sallye Clark, Planning Assistant; Jolie S. Lenz, City Legal Counsel Call to Order - With quorum present at 6:22p.m., Steve Brown called the meeting to order. 1. Notices, Rules, Etc. ZPC and staff introduced themselves. Steve Brown informed everyone that the ordinance amendment on Fences, Visibility and Emergency access passed both readings and was signed. Steve Brown polled ZPC members present to find out availability for the September 9, 2010 ZPC meeting. ZPC also requested that Alan Petrov, legal counsel attend a meeting and go over the matters related to procedures for public hearings of proposed amendments in the Zoning Ordinance. Chris Peifer infonned ZPC that there has been some discussion in City Council about separating Public Hearings on ordinance amendments between City Council and ZPC. 2. Minutes. July S, 2010. Bruce Frankel made a motion to approve the minutes as written. Motion was seconded by Dick Yehle. Ayes: Steve Brown, Dick Yehle, Sam Parikh, Bruce Frankel, and DeDe DeStefano. Noes: none. Minutes approved. 3. PNC Status. The ZPC considered and discussed a proposal from staff to amend the zoning ordinance as it pertains to PNC status per request by City Council. Debbie Scarcella, City Planner handed out sections of two different Cities' Nonconformities sections of their ordinances as comparison. Steve Brown stated the proposal in front of ZPC at tonight's meeting was crafted from recommendations by Councilman George Boehme. Changes would be in use to Commercial district light and commercial district medium. Steve Brown thinks staff should add a sentence to the general purpose section to bring about the elimination of PNC. 3800 University Boulevard 0 West University Place, Texas 77005-2899 • 713.668.4441 9 www.westu.org Page 2 After discussion, staff was instructed to make changes and bring back to the ZPC in the form of a preliminary report at the September meeting. 4. Parking Regulations. The ZPC considered and discussed a proposal from staff to amend the zoning ordinance as it pertains to off-street parking requirements for food service establishments. The proposal in the packet was not the proposal that was sent to City Council to reflect the changes. The changes were as follows: Food Service such as "dine in" restaurant space, club, cafe and similar recreation or amusement space (except space for auto-intensive uses); other retail and personal service space "including carry out servic. 2(d) If there is any "dine in" food service space; add 6.0 spaces per 1,000 square feet of gross floor area. Staff was instructed to bring back a preliminary report to the September meeting. 5. Basements. Steve Brown gave feedback from the City Council meeting where the preliminary conclusion regarding basements was discussed. The ZPC requested staff push forward on the necessary ordinance amendments to implement the preliminary conclusion dated December 14, 2009 and cover letter of March 11, 2010; that basements should not be permitted in West University Place, but regulations should allow certain partially below-grade structures (e.g., elevator wells or mechanical equipment) which are essential to above-grade functions. ZPC would like staff to develop a schedule and get back with them on what the BSC came up with at the September meeting. 6. Executive Session (if necessary). Not used Adjournment. Dick Yehle made a motion to adjourn. Bruce Frankel seconded. Ayes: Steve Brown, Dick Yehle, Sam Parikh, Bruce Frankel, and De De DeStefano. Motion passed.
