CITY COUNCIL REGULAR SESSION
MONDAY, APRIL 27,1998
COMMUNITY BUILDING

7:30 P.M.
The City Council convened in Regular Session in the Community Building (6104 Auden) on
April 27, 1998, with the following members present: Mayor Fogler presiding, Council Members
Starich, Davis, Neal and Sparkman. The City Manager, City Secretary, City Attorney, Finance
Director, Acting Police Chief, Fire Chief and Public Works Director were also present. Council
Member Davis led the Pledge of Allegiance.
CITIZEN COMMENTS:
Mayor Fogler invited citizens who wished to' address the City Council to come forward as their
names were called.
Alice Spence, 2912.Georgetown, spoke in favor of her neighbors having dogs. She liked that the
dogs barked when someone was near her property.
Murphy Klasing,. 808 Travis, stated that he was the attorney for Mary Meyer who had a neighbor
complain about her dog barking. Mr. Klasing suggested the use of a decibel meter to measure
the level of noise.
Robert Levy, 3911 Arnold, comm~nted that he was constantly disturbed by a barking dog. He
stated that it was a quality of life issue.
Darryl Friday, 3787 Bissonnet, commented that dogs could be trained not to bark by using shock
collars or dog psychiatrists.
W.L. Pryor, 2625 Arbuckle, commented that he wanted something done about the noise pollution
in the City. He stated that he could not enjoy his garden because of the barking dogs.
Carol Hershkowitz, 2617 Arbuckle, spoke in opposition to barking dogs.
Eldridge Custer, 2637 Arbuckle, asked that barking dogs be controlled.
Victor diFranco, 6412 Westchester, commented that he was against leaving dogs outside alone.
He stated that the barking dogs were under stress.
Carol Friedman, 3523 Tangley, commented that she had three dogs and was a dog trainer. She
suggested that the' City contact an animal behavorist at Texas A&M.

Craig Ward, 3906 Marlowe, commented that the problem in the city was not a dog problem but a
noise problem.
Lance Hellerman, 3905 Marlowe, commented that he thought the ordinance would be difficult to
enforce. He suggested that a better standard to follow would be if complaints came from several
neighbors about a particular barking dog.
Margo Hellerman, 3905 Marlowe, commented that the dogs were protecting the neighborhood.
Beverly Loftis, 4212 Marquette, commented that she owned three dogs and that West U was
becoming a city of whiners. She suggested that everyone work with their neighbors.
ANIMAL ORDINANCE:
Consideration was given to the first reading of Ordinance No. 1590.
A motion was made by Council Member Neal, seconded by Council Member Davis, to table
consideration of Ordinance No. 1590.

ORDINANCE RELATING TO CERTAIN TOWER PERMITS:
Consideration was given to the first and fmal reading of Ordinance No. 1591.
Mayor Fogler read the caption of Ordinance No. 1591 as follows:
AN ORDINANCE EXTENDING AN EXISTING TEMPORARY LIMITATION ON CERTAIN
TOWER PERMITS; CONTAINING FINDINGS AND PROVISIONS RELATING TO THE
SUBJECT; AND DECLARING AN EMERGENCY
Copies of Ordinance No. 1591, in the form proposed for adoption, were available in the
Community Building.

City Attorney Jim Dougherty reported that Ordinance No. 1591 would extend the 95-day
temporary limitation upon construction or enlargement of towers and related permits to 190 days.
A motion was made by Council MemberStarich, seconded by Council Member Neal, to adopt
Ordinance No. 1591 on the first and final reading.

BID AWARD FOR CHEMICALS:
Consideration was given to bids received April 8, 1998 for the purchase of polymer, chlorine gas,
sodium bisulfite and miscellaneous chemicals.
Public Works Director Ed Menville reported that of the two bids received for sodium bisulfate,
Mid-Co Chemicals submitted the only complete bid. Their bid was $1.32 per gallon of Sodium
Bisulfate, $1.05 per gallon of 10% bleach, $1.19 per pound of granular chlorine, and $1.92 per
pound of tabletized chlorine.
The bids received for Polymers were from Fort Bend Services and Armstrong Technologies.
Both bid the same price per pound ($1.15). Both performed testing on the City's press with
sludge and the assistance of the plant management supervisor. Fort Bend Services tested and
submitted the bid for the polymer, which performed best.
A.O.C. submitted the low bid for the purchase of chlorine gas. Their price was $0.22 per pound
for one-ton cylinders and $0.45 per pound for 150-pound cylinders.
A motion was. made by Council Member Neal, seconded by Council Member Sparkman, to
award bids to Mid-Co Chemicals for sodium bisulfate and miscellaneous chemicals, to A.O.C.
for chlorine gas, and to Fort Bend Services.for polymers.

PURCHASE OF VEHICLES:
Consideration was given to the purchase of three new pick-up trucks for the Public Works
Department from the City's state purchasing contract in the amount of $59,711 plus $3,500 per
vehicle for the conversion to alternate fuel.
Mr. Menville reported that the public works department needs to replace three vehicles currently
being used within the department - a 1992 compact pickup with 30,623 miles, and two % ton
pickups - one is a 1992 with 58,874 miles and the other is a 1993 with 45,430 miles. The
compact pickup is for use in the building division and the other two are for use in the field
services division.
Once the replacement vehicles have arrived at the City, they would be refitted in order to comply
with Texas Natural Resource Conservation Commission regulations for alternative fuels. The
trucks will be refitted for bi-fuel, which will enable them to run on both gasoline and propane.
The purchasing program offered through the State permits cities to buy vehicles using a state-
negotiated contract. So, in lieu of soliciting bids, the vehicles would be purchased using the
City's state purchasing contract.
A motion was made by Council Member Sparkman, seconded by Council Member Starich, to
authorize the purchase of three new vehicles for the public works department using the City's
state purchasing contract for an amount totaling $59,711, plus an additional $3,500 per vehicle
for the conversion to alternate fuel once the vehicles arrive in the City .

STAFF REPORT:
City Manager Sherman Yehlreported that the deadline for the Police Chief search is April 30.
They are expecting to have 50 to 75 applications.
COUNCIL COMMENTS:
Council Member Neal stated that she appreciated the comments from the citizens about barking
dogs.
ADJOURNMENT:
With no further business to come before the City Council at this time, a motion was made by
Council MemberSparkman, seconded by Council Member Starich, to adjourn. Theregular
Session adjourned at 8:45p.m.
