Background Information The applicant's property is located at 3622 University Boulevard just east of Poor Farm ditch. The site is located in a single-family (detached) zoning district (SF3), but has prior nonconforming (PNC) status as a business established by a special exception issued on August 19, 1999. The special exception was granted to reinstate and extend PNC status for a business activity and a business building in a single-family district. (Copy of the decision is attached.) The special exception extended the PNC status for 15 years, or until September 10, 2014. The building contains 2,390 square feet and currently is home to West University Travel. The applicant proposes to lease 1000 square feet to a fitness facility, thus creating a two business building. This will not expand (or increase) the non-conformity of the use since both types of business uses are light commercial, but will affect the minimum parking requirements. The applicant currently provides 9 regular spaces on the building site and 3 regular spaces in the immediate adjacent night of way. An additional accessible parking space is also provided in the right of way. It is likely that PNC status was acquired when updated parking regulations were enacted. Parking requirements for an office use require 4 spaces per thousand square feet of gross floor area or a minimum of 9.6 or 10 spaces for West U travel. The minimum number of required parking spaces will increase with the addition of the physical fitness business. The required number of spaces for a fitness facility is 10 spaces per 1,000 square feet. Since the fitness facility is 1,000 square feet, they would require 10 spaces, plus the remainder by the travel agency business (1,390 square feet) of 6 spaces for a total of 16 minimum number of spaces, or three more than provided. The applicant is proposing to use the front spaces and three additional stacked spaces in the rear to satisfy the additional six parking spaces. 3622 University Boulevard Page 1 Staff Response Staff believes that the ZBA has general authority to issue a variance reducing the number of required parking spaces. The burden is on the applicant to present sufficient evidence to support each required finding, determination and code requirement. In order to issue a variance, the following circumstances must be present: (1) The ZBA has made all findings and determinations required by state law for the granting of a variance. (2) The ZBA has made any additional findings and determinations required by specific provision of this ordinance which relates to the variance. (3) The variance has been reduced to writing and includes any conditions prescribed by the ZBA or required by ordinance for the variance in question. Under the Local Government Code, the following fmdings and determinations must be made to support any variance: (1) The variance is not contrary to the public interest; and, (ii) Due to special conditions, a literal enforcement of the ordinance would result in unnecessary hardship; and, (iii) The spirit of the ordinance is observed and substantial justice is done. As discussed above, the applicant will have to demonstrate the number of spaces that may have PNC status, in this particular case. The Board may also consider attaching conditions. A decision to grant a variance, for example, could logically include conditions to prevent "overflow" parking, e.g.: (1) restrictions on the operations of the new physical fitness unit; and (2) limits on the hours of operations of the businesses. 3622 University Boulevard Page 2 City f o 'west University Place ZONING BOARD OF ADJUSTMENT City of West University Place, Texas ("City") DECISION TO GRANT A SPECIAL EXCEPTION Address of Site: 3622 University Boulevard Legal Description of Site: Lot 4-A, Block 44, West University Place Second Addition Building Permit Number: Permittee/Applicant: Peter J. Decision of the Zoning Board of Adjustment (subject to all applicable appeals): Under and subject to the City's Zoning Ordinance and applicable law, a special exception to "reinstate and extend prior non-conforming ("PNC") status of a business activity (and a business building) in a Single Family District", as specifically allowed by Section 12.105 of the Zoning Ordinance, is granted: (i) to the permittee/applicant named above, (ii) to continue use of 3622 University Boulevard as a commercial business, and (iii) subject to the following conditions (if any): PNC status has been reinstated and extended for a period of fifteen (15) years. This special exception is for an indefinite period unless a temporary period is indicated above. This special exception remains subject to the regulatory jurisdiction of the city, and it does not grant any property right or vested right of any kind. Effective Date & Appeals: This decision takes effect on the date it is filed in the Board's office (c/o Secretary of the Zoning Board of Adjustment, 3800 University Boulevard, West University Place, Texas 77005) unless otherwise indicated above. We have operated our travel business, West University Travel, at that location for the last ten years. During October, 2009 we decided to sublet about %2 of the building and downsize the travel agency to the other half. As you well know the downturn of the economy has made to difficult to find tenants for commercial space. Last month I was able to find a tenant who wishes to operate an exercise facility at our location. My understanding is that the parking requirement for such a facility will exceed the available spaces on site which leads to this request for a variance. A proposed parking scenario has been proposed for your consideration. If this proposed scenario is not acceptable, we request that you approve a variance to reduce the required parking for the facility to the amount of parking spaces available. My expectations are that we will continue to have a difficult time finding a new tenant if the variance is not approved. Rental income for %2 of the lease space is approximately $3,500 per month or $42,000 per year. A), 5-23-2005) Section 9-102. Site criteria. A person applying for the establishment of a PDD must own the entire area subject to the application. Exception: In the C District, two or more persons may own the area subject to the application, if they jointly apply for a single PDD. The area must include either: (i) 40,000 square feet or more, all contiguous or separated only by a street, or (ii) 30,000 square feet or more, all contiguous. (Ord. No. 1801, § 1(ex. A), 5-23-2005) Section 9-103. Procedures. (a) Submissions. The applicant must submit a development plat (which may be the same as a plat submitted under another ordinance of the City, if allowed by such other ordinance) and a development report containing a general description of the proposed development and an analysis of traffic patterns, street areas, drainage, utilities, and maintenance of public spaces, together with any additional items the administrative official or the Z&PC may reasonably request. (b) Processing. The processing procedure for approval of a PDD shall be the same as for an amendment to this ordinance. If a PDD is approved, the Zoning District Map shall be amended to show the PDD boundaries, and a PDD schedule shall be added to this ordinance to provide the necessary regulations. (c) Review; No Entitlement. The review of a PDD, like all amendments to zoning ordinances, involves extensive procedures and legislative weighing of competing policy considerations. Therefore, no person is guaranteed or assured that a PDD either will or will not be acted upon favorably or within any given period of time, and no person shall ever be entitled to the approval of a PDD under any circumstances. ARTICLE 10. PARKING AREAS, DRIVEWAYS AND LOADING AREAS Section 10-100. Off-Street Parking.
