The applicant is requesting a special exception as authorized in Note 5 to Table 7-5a to allow an additional curb cut along University Boulevard. Backiround Information The applicant is preparing to apply for a permit to construct a new single family dwelling at 3219 University Boulevard. This building site is one-hundred and fifty feet (150') wide and one-hundred and twenty feet (120) deep after being re-platted in 2002. The lot sits at the southeast corner of University Blvd. and Rutgers. During preliminary plan review discussions with the applicant, it was noted that the proposed driveway configurations do not meet the zoning regulations. The applicant's plans propose a side loading 2 -bay garage with driveway and approach from the Rutgers side of the building site. An additional curb cut and driveway along University Blvd serving a second rear situated garage is also proposed. The second garage contains one bay and additional storage area. The driveway serving the 2- bay garage is twenty feet (20) wide with an additional 4' wide apron at the curb. The second driveway is twelve feet (12') wide in the side yard and will not exceed sixteen feet (16) at the curb. Both driveways connect the street area with garage space in the most direct route possible. Staff Response The applicant is seeking the special exception for an additional curb cut in order to facilitate the use of a second single-bay garage accessory structure. Table 7-5a limits the maximum number of curb cuts to "one per subdivided lot abutting the street." Note 5 of Table 7-5a authorizes the ZBA to issue special exceptions for additional curb cuts. In this case, both proposed driveways meet the maximum pavement width allowed per Table 7-5a, and both proposed curb cuts meet the width restriction (which is the maximum driveway width plus four feet). Note: Note 5 of Table 7-5a refers out to other ordinances, which can sometimes allow more than one curb cut. Section 70-27 of the Code of Ordinances allows two curb cuts on a wide lot with a "circular" driveway, and it limits the location and size. A special exception is not generally required for a "circular" driveway. 3219 University Blvd Staff Report Page 1 The applicant is in the process of finalizing the permit drawings and preparing to apply for a building permit. Staff Recommendation Table 7-5a, Note 5 of the Zoning Ordinance gives the ZBA authority to grant a special exception for additional curb cuts. The ZBA must find that the request is in harmony with the general purpose and intent of the Zoning Ordinance and that the request will not cause any significant increase in on-street parking or traffic, traffic congestion, or an unreasonable burden upon public utilities or services. Welsh 510 Farmington Dr. Lafayette, La. 70503 City of West University Place 27 Dec. 2009 Zoning Board OF Adjustment 3826 Amherst, Houston, TX 77005 Attention: Members of Zoning Board of Adjustment Reference to: Application for Additional Curb Cut Dear members of The Zoning Board of Adjustment, We wish to make application for a second curb cut to facilitate access to an accessory garage building for a proposed new home planed for our 3219 University Blvd. property. The location is zoned SF-1 as indicated on the West University Place Subdivision and Zoning map. This corner lot was sub-divided from a previous lot and has 30 ft. set back lines along both University Blvd. and the side street Rutgers. Thus a significant percentage of the property is reserved for front and street side yards. A condition now exists where cars are frequently parked along our vacant lot site on both Rutgers and University. To avoid exacerbating the problem and reduce congestion we wish to avoid parking vehicles of any sort in the street. We also wish to make best use of the property given so much is reserved for front and street side yards. To meet this goal we plan to construct an accessory garage building in the rear/ interior side yard to augment the primary garage along Rutgers St. The location of the accessory garage building meets the guide lines as specified in the West University Ordinance. Both driveways are consistent with existing driveway patterns along University Blvd. and Rutgers St. We do not feel the requested variance is contrary to the public interest. We do not think the requested Special Exception alters the spirit of the ordinance. The second drive way and accessory garage space allows amply parking for all owner, visitor and service parking, thus there will be little to no need for any street parking along University or Rutgers. Circular driveways specifically d by another ordinance are not prohibited. Note 6. Route; Alternating Driveways. Each driveway must connect garage space to the street by the most direct route. On narrow sites where alternate side yard areas apply (see "Yards" table), the following special restrictions also apply: (A) there must be a driveway located as nearly as practicable to one side of the site; (B) the side is determined in accordance with the established driveway pattern for the block face in question, if there is such a pattern; and (C) if there is no such pattern, and if there is an adjacent driveway on one adjoining building site but not the other, the driveway must be on the side farthest from the adjoining driveway. Exceptions: (i) this paragraph does not prohibit circular driveways specifically permitted under another ordinance of the City, and (ii) a driveway may be curved or moved away from the most direct route to the extent reasonably necessary to avoid destroying or seriously injuring a tree. Note 7. Special Exceptions. The ZBA may issue a special exception for a parking area, garage or driveway (or other maneuvering area) in another location or with a different design than prescribed by this ordinance, if it finds that: (i) the other location or design will not unreasonably interfere with available light and air and will not significantly alter access for fire-fighting and similar needs; (ii) the other location or design will prevent the destruction of a qualified tree; (iii) in the case of the remodeling of a principal building, the location requested is the same location as an existing parking area, garage or driveway; or (iv) the location or design requested is necessary for safety considerations. Note 8. Curb Cuts in PDD-THI. (i) If a building site abuts both Bellaire Boulevard and another street, then all vehicular access shall be from the other street, and no more than two curb cuts shall be allowed. However, in the case of the development of Lots 6, 7, 8, 9 and the east ten feet of Lot 10, Block 1, Kent Place Addition, if Lot 6 is included in the same building site or in a joint development with the other lots, vehicular access shall be limited to one curb cut on Mercer Street. (ii) If a building site abuts only Bellaire Boulevard, vehicular access shall be limited to two curb cuts. Note 9. Curb Cuts in PDD-TH5. (i) If a building site abuts both Academy and Bissonnet, no curb cuts on Bissonnet and no more than two curb cuts on Academy are permitted. (ii) If a building site abuts only Bissonnet, there may be no more than two curb cuts. Note 10. Driveways in PDD-TH7. Cul-de-sac driveways in PDD-TH7 may not exceed 50 feet in length, or 200 feet if a terminus is provided with dimensions adequate for turning. Note 11. Curb Cuts in PDD-TH2. W If a building site abuts both Kirby Drive and another street, there may be one curb cut on Kirby Drive and on each other abutting street.
