RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
UNIVERSITY PLACE, TEXAS ADOPTING AN EMERGENCY
PREPAREDNESS PLAN
WHEREAS, the City of West University Place, Texas (the "City") is a Home Rule
municipality and political subdivision of the state of Texas, located in Harris County,
Texas; and
WHEREAS, pursuant to the authority granted by the Constitution and laws of the
state of Texas and its Home Rule Charter, the City owns and operates a potable water
supply system; and
WHEREAS, pursuant to the requirements of Senate Bill 361, 81st Legislature,
Regular Session 2009, owners of water supply systems located in Harris County, Texas
must develop an approved emergency preparedness plan to ensure the emergency
operation of their water system during an extended power outage as soon as safe and
practicable following the occurrence of a natural disaster; and
WHEREAS, the City has previously put into place procedures to ensure the
emergency operation of its water system during an extended power outage; and
WHEREAS, the City Council supports such actions and the goals of Senate Bill
361. NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WEST
UNIVERSITY PLACE, TEXAS:
1. That the Emergency Preparedness Plan attached hereto as Exhibit "A" is
adopted and approved as the Emergency Preparedness Plan of the City.
2. That the City staff is hereby authorized and directed to file a copy of the
City's Emergency Preparedness Plan with the Texas Commission on
Environmental Quality as required by state law and to carry out the
requirements and intent of the plan when necessary.

Section I - Introduction
1. PURPOSE
This emergency preparedness plan was developed as a template for the operators and administration of affected utilities
in order to comply with the requirements for "affected utilities" in 30 Texas Administrative Code Chapter 290 Subchapter D
and Chapter 291 Subchapter H and to demonstrate the utility's ability to provide emergency operations during extended
power outages. An affected utility is a retail public utility, exempt utility, or provider or conveyer of potable or raw water
service that furnishes water service to more than one customer in a county with a population of 3.3 million or more, or in a
county with a population of 400,000 or more adjacent to a county with a population of 3.3 million or more. An extended
power outage means a power outage lasting more than 24 hours.
Emergency response planning should be a coordinated and planned process. Proper planning can lessen the impact of an
emergency.

D. Description of Surrounding Area and Susceptibility to Contamination
Description of significant potential sources of contamination in the area (approximate 1 mile radius) and
susceptibility to potential contamination:
The only significant source of water contamination within one mile of the water system is sanitary sewer and unknown
contaminants being transported mostly by rail through the area. Susceptibility of the water system to contamination
from these sources is non-existent to minimal. The City of West University Place maintains constant vigilance through
the employment of Licensed Drinking Water and Wastewater Operators. Both systems are operated in such a fashion
that it is very improbable that any drinking water contamination would appear from this source. The railroad is not
immediately adjacent to a portion of the water system that would lend itself to risk of contamination

Please provide documentation showing how fuel supply needs were calculated and how you will ensure adequate supplies of
fuel are available to maintain emergency operations. Attachment C may assist in determining that amount (example 100 kW
uses -1 gal/n r).
On site diesel fuel storage and contract with Sun Coast for emergency fuel re-supply as soon as is reasonably practicable
and safe after any emergency causing transfer to emergency generator power. See Attachment G; Fuel storage onsite
includes 898 gallons in the Generator Tank at 35 Gallons per hour under full load based on information contained in
Attachment C. This volume equates to 25 hours. We additionally have 6000 gallons of diesel in an onsite underground
storage tank which is protected from flooding as recorded historically in this area. These 6000 gallons are at risk however
slight.

Section V - Emergency Water Use Restrictions
1. EXPLANATION AND AUTHORITY
During periods of a drought, a major leak, a system failure, or excessive consumption beyond the capacity of the system,
etc., the City of West University Place has the capability to conserve and restrict water use based upon the local water
system regulations found in the City of West University Place Water Conservation/ Drought Contingency Plan. During
times of drought or other problems that limit the availability of water, public notice of water use restrictions will be issued by:

ATTACHMENT A -Approved Plan Distribution
Copies of the approved emergency preparedness and the TCEQ Approval Letter must be distributed to the following
entities (this section cannot be completed until after approval letter is received from TCEQ). Please maintain appropriate
documentation of compliance with plan distribution requirements. In addition, a copy of the approved plan must be
maintained by the "affected utility", so that it can be easily accessed in the event of an emergency. All employees must
receive annual training on implementation of the plan.

The affected utility must notify the public when a condition exists which according to TCEQ constitutes an acute public
health threat in accordance with 30 TAC §290.46(q).

Mandatory Language for a Boil Water Notification
Due to (Condition creating need to issue boil water notice), the Texas Commission on
Environmental Quality (TCEQ) has required our public water system, THE CITY OF
WEST UNIVERSITY PLACE WATER SYSTEN, PWS ID 1010027, to notify all customers
to boil their water prior to consumption.
To ensure destruction of all harmful bacteria and other microbes, water for drinking,
cooking, and for making ice should be boiled and cooled prior to consumption. The
water should be brought to a vigorous, rolling boil and then boiled for two minutes. In
lieu of boiling, you may purchase bottled water or obtain water from some other
suitable source.
When it is no longer necessary to boil the water, the water system officials will notify
you that the water is safe for consumption. The rescind notice will be issued in the
same manner as this Boil Water Notice.

Suggested Language for a Boil Water Rescind Notice
On <insert date>, the Texas Commission on Environmental Quality (TCEQ) required the
CITY OF WEST UNIVERSITY PLACE, PWS ID No. 1010027, to issue a Boil Water Notice
(BWN) to inform our customers that due to the presence of contaminants or an interruption
in service, water from our system must be boiled prior to consumption.
Our system has taken the necessary corrective actions to restore adequate pressure,
disinfectant levels, and/or bacteriological quality and has provided TCEQ with testing
results that indicate that the water no longer requires boiling.

If you plan on utilizing options 1, 2, 4, 5, or 6, you will need to estimate the gallons per hour of fuel that will be used by the
generator. This is essential in order to determine the volume of fuel required to meet the 72 hour supply. Below is a chart

ATTACHMENT D - RECOVERY CHECKLIST
Returning to normal operations is vital to rapid restoration of clean, safe water to the community and is essential to the
assessment and recovery process. The following is a checklist of actions to be taken during the recovery period. Also
included is a preliminary damage assessment that can be used to assist in the recovery process.
Assessment and Recovery Period Checklist
❑ Perform in-depth damage assessment of system to determine long-term effects of damaged areas (use assessment
form below).
❑ Notify TCEQ of system operational status and situation.
❑ Will there be a need to use mutual aid agreements and/or implement standby contracts or other emergency
agreements for equipment and operations?
❑ Prepare written documentation of emergency work performed for possible compensation by emergency agencies.
Make sure that crews make a record of work effort, written logs (see Work Order Log) and take pictures. This will all
be helpful in recovery of funds.
❑ Notify appropriate insurance carriers. Provide written and photo documentation of damage.
❑ Assist in the survey of emergency repairs and scheduling of permanent repairs.

In order to request assistance from local and state jurisdictions, your must complete and submit a 213 form to your local
Emergency Manager or Emergency Operations Center (EOC). If the request is approved and cannot be met locally, the
request is forwarded to the Disaster District Committee (DDC) for your area for review and prioritization. If the request is
approved and cannot be met at a regional level, the request if forwarded to the State Operations Center in Austin. You can
either: (1) complete a paper form and take it to your local EOC or DDC; (2) log onto www.txwarn.orq and complete an on-
line request which automatically generates a 213 and forwards to all above-mentioned parties or (3) call or TEXT 1-866-
9TXWARN to request assistance and they can complete the form on your behalf.
The more information you include in the request, the more likely you will receive what you need in an expeditious manner.

DROUGHT CONTINGENCY PLAN
Section 1 - Declaration of Policy, Purpose, and Intent
In cases of extreme drought, periods of abnormally high usage, system contamination, or
extended reduction in ability to supply water due to equipment failure, temporary restrictions will
be instituted to limit non-essential water usage. The purpose of the Drought Contingency Plan is
to encourage, and under emergency conditions require, customer conservation in order to
maintain supply, storage, or pressure.
Section 2 - Public Involvement
Opportunity for the public to provide input into the preparation of the Plan was provided by
posting of Notice of Council Meeting to approve ordinance adopting Drought Contingency Plan.

Section 3 - Public Education
The City of West University Place will periodically provide the public with information about the
Plan, including information about the conditions under which each stage of the Plan is to be

Drought plan information will be provided by press release and utility bill notice advising of
availability of plan on internet web site or from Utility Billing Office. Additional information will be
provided at various sponsored events throughout the City.
Section 4 - Coordination with Regional Water Planning Groups
The service area of the City of West University Place is located within Regional Water Planning
Group H and a copy of this plan has been mailed to this planning group.

Section 5 - Notice Requirements
Notice will be provided to each customer prior to implementation or termination of each
stage of the water restriction program. Notice will be provided through posting on City web
site, news release to radio, television and newspaper. The notice will include:
• The date restrictions will begin
The circumstances that triggered the restrictions
• The stages of response and explanation of the restrictions to be implemented
• An explanation of the consequences for violations.
The utility will notify the TCEQ by telephone at (512) 239- 6020, or electronic mail at
watermon@TCEQ.state.tx.us upon implementation the program and will notify in writing
the Public Drinking Water Section at MC - 155, P.O. Box 13087, Austin Texas 78711-3087
within five (5) working days of implementation including a copy of the utility's restriction
notice. The utility must file a status report of its restriction program with the TCEQ every
30 days that restriction continues.
Section 6 - Violations
First violation - The customer will be notified by written notice of their specific violation.
Subsequent violations:
• A municipal court citation will be issued for violation of the City Code of Ordinances and
will result in a fine of up to $500.00 per day the violation continues.
• Continued violations may result in termination of water service.
Section 7 - Exemptions or Variances
The Building & Standards Commission may grant variance from requirements of this Plan in
accordance with the same standards and procedures applicable to building-related variances;
see Chapter 6 of the Code of Ordinances. An applicant who is refused a variance may appeal
such action to the City Council. Any person seeking an exemption from this Plan may apply in
writing to the City Council and must demonstrate good cause for the exemption. The City
Council will treat all customers equally concerning exemptions and variances, and shall not
discriminate in granting exemptions and variances. No exemption or variance shall be
retroactive or otherwise justify any violation of this Plan occurring prior to the issuance of the
exemption or variance.

Section 8 - System Supply Strategy
The City of West University Place water system is supplied with a combination of well water and
surface water. The well water is supplied by water wells owned and operated by the system and
can safely supply our annual daily average. The Surface water supply is through a purchase
agreement with the City of Houston, Texas and this supply can safely supply our daily annual
average. With limitations on either of these supplies during peak pumping seasons it may be
necessary to implement water usage restrictions. The City of West University Place has two
pump stations either of which can pump well water, surface water or a combination of both.
Either pump Station can safely supply the daily average flow but may require usage restrictions
in the event of equipment outages during peak water pumping seasons.
Section 9 - Response Stages
The City will communicate Stage I concepts each year. If, supply or demand triggers are met
the city will initiate the appropriate elevated Stage of restrictions.
STAGE I - ANNUAL DROUGHT AND CONSERVATION AWARENESS CAMPAIGN
Utility Measures
A public announcement will be issued every April to increase customer awareness of water
conservation and encourage the most efficient use of water. This announcement will include
information on obtaining an electronic or paper copy of this Plan. A copy of the current public
announcement on water conservation awareness shall be kept on file available for inspection by
the TCEQ.
Voluntary Water Conservation
Water customers are encouraged to practice water conservation.
STAGE II -VOLUNTARY WATER USE RESTRICTIONS
Stage II is designed to encourage customers to conserve water during periods when water
supplies are unusually limited. Stage 2 will begin when:
Supply-Based Triggers
• City of Houston initiates voluntary water restrictions.

Demand- or Capacity-Based Triggers
• Total daily demand - 65% of pumping capacity for three (3) consecutive days.
Upon initiation and termination of Stage II, notify all customers by placing notice on
city's web site and by press release to radio, television and newspapers.
Requirements for termination
Stage II of the Plan may end when all of the conditions listed as triggering events have ceased
to exist for a period of five (5) consecutive days.
Utility Measures
• Visually inspect lines and repair leaks on a daily basis.
Voluntary Water Use Restrictions
• Voluntary Restricted Hours: Outside watering is allowed daily, and encouraged to water
only during the hours between 10:00 PM and 5:00 AM.
STAGE III - MODERATE WATER USE RESTRICTIONS
Stage III is designed to take affirmative steps to control the use of water in response to a period
of significant water shortage. Stage 3 will begin when:
Supply-Based Triggers
• Equipment outage reduces well capacity by 50% or purchased water intake is limited to
less than 75% of standard average draw rates.
Demand- or Capacity-Based Triggers
Total daily demand - 70% of pumping capacity for three (3) consecutive days.
Upon initiation and termination of Stage III, notify all customers by placing notice on
city's web site and by press release to radio, television and newspapers.
Requirements for termination
Stage III of the Plan may end when all of the conditions listed as triggering events have ceased
to exist for a period of five (5) consecutive days. Upon termination of Stage 3, Stage II may
become operative.

• Water line flushing is prohibited except for dead end mains or identified quality control
issues
Mandatory Water Use Restrictions
The following water use restrictions shall apply to all customers:
• Outside watering is allowed daily, but only during the hours between 10:00 PM and 5:00
AM. Watering of plants and landscaping shall be allowed with a hand held water hose
between the hours of 7:00 PM and Midnight and the hours of Midnight and 10:00 AM.
• Use of water to wash any motor vehicle, motorbike, boat, trailer, airplane or other vehicle
is prohibited except between the hours of 7:00 PM and 10:00 a.m. Such washing, when
allowed, shall be done with a hand-held bucket or a hand-held hose equipped with a
positive shutoff nozzle for quick rinses. Further, such washing may be exempted from
these regulations if the health, safety, and welfare of the public is contingent upon
frequent vehicle cleansing, such as garbage trucks and vehicles used to transport food
and perishables.
• Use of water to fill, refill, or add to any indoor or outdoor swimming pools, wading pools,
or "Jacuzzi" type pools is prohibited except between the hours of 12:00 midnight and
10:00 a.m.
• Operation of any ornamental fountain or pond for aesthetic or scenic purposes is
prohibited except where necessary to support aquatic life or where such fountains or
ponds are equipped with a re-circulation system.
• Use of water from hydrants or flush valves shall be limited to maintaining public health,
safety, and welfare.
• Use of water for the irrigation of parks, and green belt areas is prohibited except
between the hours 12:00 midnight and 5:00 a.m. and between 8 p.m. and 12:00
midnight.
• The following non-commercial uses of water are defined as non-essential and are
prohibited:
o Wash down of any sidewalks, walkways, driveways, parking lots, tennis courts,
or other hard-surfaced areas
o Use of water to wash down buildings or structures for purposes other than
immediate fire protection

o Use of water for dust control
o Flushing gutters or permitting water to run or accumulate in any gutter or street
o Failure to repair a leak(s) within 72 hours after having been given notice directing
the repair of such leak(s).
STAGE IV - CRITICAL WATER USE RESTRICTIONS
Stage IV is designed to take significant steps to control the use of water in response to periods
of critical water shortage. Stage IV will begin when:
Supply-Based Triggers (Either condition may trigger restrictions)
• Supply contamination
• Equipment outage reduces well capacity by 100% or purchased water intake is limited to
less than 60% of standard average draw rates
Demand- or Capacity-Based Triggers (Either condition may trigger restrictions)
• Total daily demand as 80% of pumping capacity for (3) three consecutive days
• Production or distribution limitations
• System outage.
Upon initiation and termination of Stage IV, the utility will notify Its customers and the
TCEQ.
Requirements for Termination
Stage IV of the Plan may be rescinded when all of the conditions listed as triggering events
have ceased to exist for a period of five (5) consecutive days. Upon termination of Stage IV,
Stage II or Stage III may become operative.
Operational Measures
The utility shall visually inspect lines and repair leaks on a daily basis. Water line flushing is
prohibited except for identified water quality issues and only between the hours of 9:00 p.m. and
3:00 a.m. Police and Code Enforcement personnel will be asked to maintain vigilance for
violations of the water restrictions.

I. Description of Services: Beginning on September t , 2009, Vendor shall provide the
following services:
Site Assessment of generator(s), within seven days ofcontract execution.
_ • 'Sampling of diesel fuel currently in generator(s). Said testing shall be accomplished within
ten days of contract execution and annually thereafter.
• Vendor stall not be responsible for the quality of fuel in generators) or supply tank(s) if
Initial fuel sample Is determined to be off specification. Based on the results of the fuel
sampling, vendor shell perform chemical corrections and/or Offering of the fuel to remedy
any product deficiencies, if possible, all at Customer's expense.
• During power outages, and upon Customers notification to Vendor, priority fueling
shag be provided by Vendor based on fuel and truck availability. Scheduled
deliveries shall be made within 7 day after notification and as required thereafter,
until such time as utility power has been restored at customers expense,
• Vendor stall Inspect Customers diesel fuel tanks on a quarterly basis, and 91 the

Customer. In the event Vendor spills fuel while delivering into Customers generator

reason, Vendor shall provide spill response services to Customer for a fee, upon
request by Customer, within four hours after contact, If within a renewable

time and materials for such spill response services.
II. Payment for Services:
• Customer shall make payment for Vendor services on a net 30 day basis. (EFT available)
