• Place City of West Urfiversity Memo To: Zoning Board of Adjustment From: Debbie Scarcella, City Planner Date: October 13, 2008 Re: Staff Report for Docket 08-06 ,41)plicaut's Request. The applicant in Docket 08-06, Jack Ballard, Representative for St. Andrew's Presbyterian Church, is requesting a special exception to authorize accessory uses for an existing place of worship in the SF-3 District. The locations are 5308 Buffalo Speedway and 3303 Bissonnet. Background. This request stems fiom St. Andrew's proposed project to add classroom buildings, modify a rear drop-off/entry area and remodel the fellowship hall. Table 7-1 ("Uses") of the Zoning Ordinance generally allows places of worship in all districts. Note 3 of that table allows the ZBA to "issue a special exception to authorize additional uses and structures," if they are "accessory to a lawfill primary use" and "compatible with nearby sites and their uses." Such a special exception may include a site plan identifying and limiting such uses and structures. The "additional uses and structures" requested by applicant are: (i) parking, (ii) outdoor kids play area, (iii) Sunday school, (iv) day care, (v) indoor kids play area, (vi) Fellowship Hall, (vii) Gathering Hall, (viii) office and (ix) kitchen. Note: The applicant is preparing a simplified site plan identifying these additional uses and structures; it should be available by the time of the hearing. The applicant has conducted the required neighborhood briefing per Section 11-101 of the zoning regulations for this special exception request. (See section 5 of the application packet). The applicant also conunissioned a traffic impact analysis and has entered into an off-site parking agreement with KTRK Television, Inc. which is directly across Bissonnet and within 300 feet of the entrance to the building. This type of agreement is allowed under Section 10-103 (a) ("Same Site Rule") of the zoning regulations. Based on the square footage of the existing buildings and the proposed modifications and additions (48,974 square feet), the total number of parking spaces required is 167. Article 10-100 of the zonu7g regulations requires 10 spaces plus 3.33 per 1,000 square feet of gross floor area in excess of 2,000 square feet for this use. (10 spaces + 3.33 x 47 = 167 spaces.) The church site provides 94 on-site spaces, and there are 73 off-site spaces (KTRK site). St Andrew's Staff Report Page 1 • Staff Response. To issue any special exception, the ZBA must determine that the special exception will not cause: (1) any increase in on-street parking, (ii) any substantial traffic congestion or (iii) any substantial increase in traffic or an unreasonable burden on utility systems or any other public facility or public service. The ZBA must also determine that the special exception will be in harmony with the general purpose and intent of the Zoning Ordinance. See Section 11-102 of the Zoning Ordinance. For this particular special exception, the ZBA must also find and determine that each additional use and stricture is: (1) accessory to a lawful primary use and (2) compatible with nearby sites and their uses. As a practical matter, the applicant will have to demonstrate the "lawful primary use" by showing that the main worship spaces have prior non-conforming (PNC) status. In 1945, City Council granted pennission for constriction and certain uses of the site (see attached Ordinance No. 292). In 1987, that ordinance was supplanted by a comprehensive revision of the Zoning Ordinance. The 1987 revision required that churches in SF districts obtain a special exception. A 2005 amendment eliminated that requirement (for all places of worship). However, the 2005 amendment required that "high-density occupancies" obtain a special exception. Therefore, to demonstrate PNC status in this case, the applicant would have to show that the main worship spaces were "constructed or established" lawfully prior to the 1987 and the 2005 amendments---and that they did not lose PNC status in the meantime. PNC status can be lost by demolition, casualty loss, expansion, etc.; see Section 12-103. (The applicant also has the continuing option to apply for a special exception---under the current ordinance---to cover the main worship spaces.) Staff believes that the applicant should be able to present evidence at the hearing sufficient to enable the ZBA to make required determinations. Staff has not received any correspondence either for or against the proposed request. Staff believes that the ZBA has the authority to grant a special exception to applicant, if the above- listed determinations are made. Under Section 11-103, the ZBA may impose conditions in a special exception, to the extent necessary to enable the ZBA to make the determinations listed above. Table 7-1, Note 3 of the Zoning Ordinance specifically allows the ZBA to "include a site plan identifying and limiting" the additional uses and structures that may be authorized in the special exception. Staff recommends that such a site plan be included, if the special exception is granted. These improvements include a classroom addition, a vehicle drop off addition, as well as new colonnades. The site will maintain current access points located on Rutgers Street west of the church. Location Map The purpose of this report is to summarize the traffic impacts of the proposed site improvements at the following intersections: • Bissonnet Street and Buffalo Speedway • Bissonnet Street and Rutgers Street • Rutgers Street and Albans Street • Albans Street and Buffalo Speedway The study included collecting the existing traffic volumes required for the analysis. A trip generation analysis was performed to determine the number of trips anticipated as a result of the proposed improvements. The generated traffic was distributed based on the existing traffic patterns in the area. All assumptions and analyses were based on the Institute of Transportation Engineers Trip Generation Manual 7th Edition. A level of • service (LOS) analysis was performed using Synchro 6.0 TCB 2 • 2.0 Project Site Description The proposed improvements will consist of a classroom addition with approximately 20 additional students, a vehicle drop off addition, as well as new colonnades. The site will maintain the current access points which are located on the west side of the church. However, the entrance and exit will be reversed. Currently the entrance is located just south of Bissonnet Street along Rutgers Street and the exit just south of the entrance. The current exit will be converted to an entrance in order for vehicles to enter the proposed drop off addition located on the southeast corner of the church parking lot. See Exhibit 1 of Appendix A to view the existing site plan with proposed improvements. 3.0 Existing Traffic Volumes and Gravity Existing traffic turning movement counts for the weekday AM and PM peak periods as well as the Sunday peak period were obtained at the following intersections: • Bissonnet Street and Buffalo Speedway • Bissonnet Street and Rutgers Street • Rutgers Street and Albans Street • Albans Street and Buffalo Speedway The time intervals for these traffic turning movement counts are as follows: • Weekday between 7am to 9am and 4pm to 6pm on 07/24/08 • Sunday between 11 am to l pm on 07/27/08 In addition, bi-directional 24 hour traffic counts were performed on the same days on Rutgers Street just south of Bissonnet Street. The existing traffic turning movement counts for the weekday AM and PM peak periods, Sunday peak period, and 24 hour traffic counts are found in Appendix B. Exhibit 2 in Appendix A shows a graphical representation of the existing traffic volumes for the weekday AM and PM peak hours as well as the Sunday peak hour. The existing gravity of an area is normally determined by analyzing a major intersection in close proximity to see what direction vehicles are originating from when entering the intersection and what direction they are traveling to when exiting the intersection. However, due to the existing roadway network in the surrounding area, one intersection could not be used to determine a general existing gravity for the entire area. • 3 TC B • Based on the current roadway network, a gravity was determined by examining the traffic pattern of vehicles entering or leaving Rutgers Street at the intersections of Bissonnet Street and Albans Street since the entrance to the church is located along that street. The adjacent properties consist primarily of residential development. • Bissonnet Street is a four-lane roadway separated by a raised median and is located at the north side of the existing site. The adjacent properties consist of both residential and commercial development. • Buffalo Speedway is a four-lane roadway separated by a raised median at some areas and is located on the east side of the existing site. The adjacent properties consist of primarily residential developments. • Albans Street is a two-lane local street separated by a raised median and is located at the south side of the existing site. The adjacent properties consist primarily of residential. 5.0 Trip Generation A trip generation analysis was performed for the AM and PM peak hours to determine the number of trips anticipated as a result of the proposed improvements of the existing site. All assumptions and trip generation rates used in this study are based on the Institute of Transportation Engineers Trip Generation Manual 7th Edition. • 4 TCB • A vehicle accessing the new development while on its way from an origin to an ultimate destination is considered a pass-by trip. Such trips do not add new traffic to the adjacent street system. Normally these trips are included in the number of vehicles accessing the new development, and subtracted from the through traffic on the adjacent streets. However, for this report, pass-by trips were ignored due to the fact that the site will have trips that are final destinations. A vehicle accessing more than one of the facilities in the new development is considered a multiple trip. Normally, multiple trips are subtracted from the total number of new trips generated by the development. This is a typical case in a commercial development and not for a church, school or residential developments. Based on the information provided, approximately 20 new students are expected to use the new classroom facility during the weekday school hours. Therefore, the number of trips generated was based on the number of additional students accessing the new classroom. Table 2 and Table 3 show the trip generation volumes for the proposed improvements during the weekday AM and PM peak hours. This assumption is based on the fact that although the new classroom may be occupied on a Sunday, the trips associated with this are already included in the existing volumes since families are most likely already attending the services at the Church and will not lead to any additional trips. Therefore, trip generation was excluded for the peak hour on a Sunday. 6.0 Trip Distribution Trips entering and exiting the existing development with proposed improvements were distributed to the existing roadway network based on the assumed existing area gravity. • Exhibit 3 of Appendix A shows the generated traffic assigned to the street • network impacted by the new development for the AM and PM peak hours. 5 TCB • Exhibit 4 of Appendix A shows the projected network traffic volumes for the AM and PM peak hours as well as the Sunday peak hour. This includes existing traffic volumes and the expected generated traffic for the proposed improvements at the site. It should be noted that the existing traffic volumes were not projected forward due to the assumption that the proposed developments will provide the growth to the area. 7.0 Intersection Level of Service (LOS) Analysis An intersection LOS analysis provides a measure of delay and service condition for all approaches of the intersection. The Highway Capacity Manual (HCM) uses LOS as a qualitative measure to describe the operating conditions at signalized intersections. The LOS ranges from A through F, representing driving conditions from best to worst, respectively. LOS A represents free-flow conditions with no congestion while LOS F represents severe congestion with significant delays. For the purpose of this study, LOS D or better was assumed as an acceptable LOS at an intersection. An intersection level of service analysis can be performed for both a signalized and unsignalized intersection. • An intersection LOS analysis was performed using Synchro 6.0 for the following intersections: • Bissonnet Street and Buffalo Speedway (signalized analysis) • Bissonnet Street and Rutgers Street (unsignalized analysis) • Rutgers Street and Albans Street (unsignalized analysis) • Albans Street and Buffalo Speedway (unsignalized analysis) These intersections were modeled for existing and proposed conditions. The delay and LOS results for the AM and PM peak hours at each intersection are shown in Table 4 through Table 7 below.
