HomeMy WebLinkAbout10162008 ZBA Staff Report DKT 2006-08 (EXT) i 0 City of West University Place eTexas Memo To: Zoning Board of Adjustments From: Debbie Scarcella, Chief Building Official Date: October 12, 2008 Re: Staff Report for Time Extension Request Docket 06-08 Background Information The applicant in Docket 06-08, 3116 Rice Blvd., requested a variance to the Zoning Ordinance regarding Table 7-2, entitled "Yards (or setbacks)". Table 7-2 establishes the yards or setbacks required for each building site based on lot depth and width. Generally in SF districts, there must be an interior side yard of 10% of the building site width or five feet, whichever is greater. The applicant planned an addition to the residence that extended the structure toward the side property line. The addition would include a porte a cochere with living space above. The width of the lot is 75', so a 7.5' side yard setback was required. The applicant requested a variance to allow the side setback to be reduced to five feet on the interior side yard in order to protect a red oak tree located in the middle of the lot. The ZBA granted a variance on November 16, 2006 in Docket 06-08 to allow the structure to be built five feet (instead of 7.5 feet) from the side property line provided that the buildings and driveway (both existing and proposed) do not exceed the sizes and locations shown on the attached exhibits A, B & C. The decision was signed and filed in the Board's office on December 7, 2006. The decision was also recorded in the real property records of Harris County on December 12, 2006. The decision states that "all permits required for the work contemplated by this decision must be applied for on or before the 90"' day following the effective date of this decision, and such work must be completed in accordance with such permits on or before the second anniversary of the date of the decision." Request The applicant submitted documentation for the permit application on March 7, 2007. The permit was issued on June 6, 2008. These dates are within the time frames required by the decision. Due to several issues and setbacks, however, the work will not be completed by the second anniversary of the decision (November 16, 2008). Per the ZBA rules of procedure, and conditions of the decision, any extension of time is prohibited to be granted without authorization from the board. Additional notice or hearing is not required to grant a time extension to complete the work. The applicant has attached a written project schedule which outlines a plan of completion by the end of February 2009. In order to accommodate possible weather delays, the applicant is requesting an extension not to exceed 4 months, or through March 16, 2009, to complete the permitted work. 3116 Rice Blvd (Time Extension) Staff Report Page 1
