HomeMy WebLinkAboutORD 1907 Authorizing Declaration of Weslayan Utility EasementCity of West University Place Harris County, Texas Ordinance No. 1907 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS AUTHORIZING THE EXECUTION OF A DECLARATION AND RESERVATION OF UTILITY EASEMENT AND ABANDONMENT OF PUBLIC RIGHT OF WAY TO RESERVE A TWO AND ONE-HALF FOOT (2.5)' UTILITY EASEMENT ALONG THE EAST AND WEST SIDES OF WESLAYAN ROAD AND TO ABANDON THE CITY RIGHT-OF-WAY IN THE SAME LOCATION. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS THAT: Section 1. The City Council of the City of West University Place (the "City Council") adopts the finding of facts and conclusions hereinafter described. Section 2. The City Council authorizes the Mayor and the City Secretary of the City of West University Place to sign and execute, for and on behalf of the City of West University Place, an instrument entitled "Declaration and Reservation of Utility Easement and Abandonment of Public Right of Way" concerning such property interest as therein described in the form attached hereto as Exhibit "A" to the Ordinance and incorporated herein for all purposes. Section 3. If any word, phrase, clause, sentence, paragraph, section or other part of this Ordinance or the application thereof to any person or circumstance, shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, neither the remainder of this Ordinance, nor the application of such word, phrase, clause, sentence, paragraph, section or other part of this Ordinance to any other persons or circumstances, shall be affected thereby. Section 4. The City Council officially finds, determines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this Ordinance was discussed, considered or acted upon was given in the manner required by the Texas Open Meetings Act, as amended, and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action. The City Council ratifies, approves, and confirms such notices and the contents and posting thereof. Section 5. This Ordinance takes effect immediately upon its passage and adoption on second reading. PASSED, APPROVED AND ADOPTED ON FIRST READING on the 91h day of November, 2009. Lenz M yor Bob Kell Recommended: (l~ V P-4,0, - City Mana r Michael Ross i Approved as to legal form: City Attorney Alan Petrov 2 Exhibit "A" DECLARATION AND RESERVATION OF UTILITY EASEMENT AND ABANDONMENT OF PUBLIC RIGHT-OF-WAY THE STATE OF TEXAS § § KNOW EVERYONE BY THESE PRESENTS: COUNTY OF HARRIS § THAT the City of West University Place, Texas, a municipal corporation organized under the laws of the State of Texas as a home-rule city, being situated in the County of Harris, State of Texas, does hereby declare, establish, and reserve, on behalf of and unto itself, its successors and assigns, two and one-half foot (2.5') wide utility easements in, across, under, and upon each of the portions of the real properties more particularly described in Exhibit "A" attached hereto and made a part hereof, which utility easements are hereby declared, established, and reserved in the exact dimensions and locations as the two and one-half foot (2.5') wide rights of way conveyed to the County of Harris by virtue of those certain "Conveyance of Right of Way" deeds more particularly described in Exhibit "B" attached hereto and made a part hereof, the recordation of which deeds are also incorporated by reference herein for all purposes as the same are filed for record in the Real Property Records of Harris County, Texas. FURTHERMORE, save and except for the utility easements hereinbefore expressly reserved, the City of West University Place does hereby abandon all of its title and interest in and to the aforementioned rights of way as the same are filed for record in the Real Property Records of Harris County, Texas. This Declaration and Reservation of Utility Easement and Abandonment of Public Right of Way, however, is made subject to any and all other restrictions, encumbrances, easements, covenants and conditions, if any, relating to the hereinabove described properties as the same are filed for record in the Real Property Records of Harris County, Texas. TO HAVE AND TO HOLD all of the right, title and interest in and to the above- described property and premises, together with all and singular the rights and appurtenances thereto in any way belonging, unto the grantees as identified by reference to prior recorded instruments, whether said reference would be general or specific, it being the intent of this instrument for the City of West University Place to relinquish any and all claims or interest in and to the right-of-way and fee ownership in the subject property but reserving unto itself the prior dedication of the surface for public use as a utility easement; so that neither the City of West University Place not its legal representatives or successors, if any, shall at any time have, claim or demand any fee title to the aforesaid property, premises or appurtenances or any part thereof, but subject as aforesaid.
