August 13, 2009
MEMBERS PRESENT: Steve Brown, Dick Yehle, Allan Elkowitz and
Bruce Frankel

Call to Order - With quorum present at 6:16 p.m., Steve Brown called the meeting to
order.
1. Notices, Rules, Etc. Steve Brown welcomed everyone and ZPC members and staff
introduced themselves
2. Minutes.
July 9, 2009. Bruce Frankel made a motion to approve as written. Dick Yehle
seconded. Ayes: Steve Brown, Dick Yehle, Allan Elkowitz and Bruce Frankel
Noes: none. Motion passed. Minutes approved.
3. Fences. Debbie Scarcella and Josh Golden went over the draft, "proposal relating to
fences, visibility and emergency access, revised 8-13-09. After discussion, ZPC
requested that note 14 be revised as follows: Fence-like hedges
within ten feet of a front yard line of a site containing a principal building which faces
a front street line and fence-like hedges perpendicular to the street are not prohibited.
Under section 82-7, under point of vertical measurement for driveway visibility
triangles ZPC requested removal of what was written and it should read: "adjacent
grade level at the intersection of the driveway and sidewalk"; Enforcement to
become (8) and change the wording to read " and the City shall have no liability for
taking or not takin such action prior non-conforming status of certain fence like
hedges to become ; under (2) remove 'for a period exceeding 30 days in any given
one year period beginning on the date such hedge is made to conform with this
section Termination to become (1);Also add a sentence about automatic removal of
(d) and (1) after October 1, 2014.
After discussion, Dick Yehle made a motion to forward to City Council, the proposed
amendment dated 8/13/09 in the form of a Preliminary report with the requested
revisions from tonight's meeting. Allan Elkowitz seconded. Ayes: Steve Brown,

Dick Yehle, Allan Elkowitz and Bruce Frankel. Noes: none. Motion passed.
4. Basements and other Subterranean Structures. Steve Brown reported on the
discussion by the BSC at their last meeting regarding the chart staff consolidated.
The commission went through the chart again and determined those areas where BSC
and the commission were not in consensus. Staff was instructed to set up a mini
workshop with the BSC and ZPC chair and one other member of each commission so
that discussion to work toward a consensus in anticipation of a first draft of an
ordinance could take place. Staff will try to set up the meeting following the next
BSC meeting.
Adjournment. Bruce Frankel made a motion to adjourn. Allan Elkowitz seconded.
Ayes: Steve Brown, Dick Yehle, Allan Elkowitz and Bruce Frankel.
