HomeMy WebLinkAboutORD 1901 Increasing Parks and Recycling Board MembersCity of West University Place Harris County, Texas Ordinance No. 1901 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS; AMENDING CHAPTER 2, ARTICLE II, OF THE CODE OF ORDINANCES OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS, BY AMENDING SECTION 2-25, ENTITLED BOARDS, COMMISSIONS AND COMMITTEES, TO INCREASE MEMBERSHIP ON THE PARKS AND RECREATION AND RECYCLING AND SOLID WASTE REDUCTION BOARDS. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS THAT: Section 1. Chapter 2, Article II of the Code of Ordinances of the City of West University Place, Texas is amended by the repeal of the existing Section 2-25 and the adoption of a new Section 2-25 to read as set out in Appendix A, attached hereto. All other portions of Chapter 2 of the Code of Ordinances not specifically amended hereby remain in full force and effect. Section 2. All ordinances and parts of ordinances in conflict with this Ordinance are repealed to the extent of the conflict only. Section 3. If any word, phrase, clause, sentence, paragraph, section or other part of this Ordinance or the application thereof to any person or circumstance, shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, neither the remainder of this Ordinance, nor the application of such word, phrase, clause, sentence, paragraph, section or other part of this Ordinance to any other persons or circumstances, shall be affected thereby. Section 4. The City Council officially finds, determines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this Ordinance was discussed, considered or acted upon was given in the manner required by the Texas Open Meetings Act, as amended, and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action. The City Council ratifies, approves and confirms such notices and the contents and posting thereof. Section 5. This Ordinance takes effect immediately upon its passage and adoption on second reading. Boards, commissions and committees. (a) Permanent bodies; liaisons. Permanent boards, commissions and committees are as follows: (1) Building and standards commission. See chapter 18 of this Code (buildings chapter) and V.T.C.A., Local Government Code ch. 54 for the composition and duties of this commission. The presiding officer shall be selected by the city council. The staff liaison is the building official, or such other person as the city manager may designate. (2) Zoning and planning commission. See the charter and the zoning ordinance for the composition and duties of this commission and the presiding officer (who is elected by the board). The staff liaison is the city planner, or such other person as the city manager may designate. (3) Zoning board of adjustment. See the charter and the zoning ordinance for the composition and duties of this board and the presiding officer (who is elected by the board). The staff liaison is the city planner or such other person as the city manager may designate. (4) Parks and recreation board. Eleven positions (numbered 1 through 11), with position 1 selected by the Board of Directors of the Friends of West University Parks Fund, a nonprofit corporation ("Friends") from among its regular members, and all other positions selected by the city council. See chapter 58 for the duties of this board and relating to the Friends. The staff liaison for both the Board and the Fund is the parks and recreation director, or such other person as the city manager may designate. (5) Senior services board. Fifteen positions (numbered 1 through 15), with all positions appointed by the city council. The senior services board is responsible for: a. Studying the needs of senior citizens; b. Assisting with service studies and plan development; and c. Making recommendations to the city council on senior citizen programs. The staff liaison is the Parks and Recreation staff member who has principal responsibility for senior citizen programs, or such other person as the city manager may designate. (6) Recycling and solid waste reduction board. Eleven positions (numbered 1 through 11), with all positions appointed by the city council. The recycling and solid waste reduction board is responsible for: a. Studies and recommendations on recycling and solid waste; and b. Community education on matters relating to recycling and solid waste. The staff liaison is the public works director, or such other person as the city manager may designate. (b) Other bodies. Other committees, commissions or task forces may be created or appointed from time to time, including the charter review committee contemplated by the charter. (c) Notices of meetings; agendas. All boards, commissions, committees and task forces are requested to post the date, time and place of their meetings. State law may impose additional requirements (e.g., open meetings law postings for zoning bodies and the building and standards commission). The staff liaison is responsible for preparing the notice and agenda for each meeting and may place subjects on the agenda. The staff liaison must place a subject on the agenda if the subject is requested by the presiding officer or by two or more regular members. Requests by members must be in writing and delivered to the staff liaison by 5:00 p.m. on the sixth day preceding the meeting. (d) Liaisons, city attorney, engineers. Designated staff liaisons are authorized to provide support and assistance for each board, commission or committee, including expenditures budgeted for that purpose. If any project requires an unusual amount of staff time or money, it should be approved by the city manager or the city council. Only the mayor, the city manager or the city council may authorize the city attorney or any outside consultant to provide services for a board, committee, commission or task force.
