STAFF SUMMARY (1) Mr. James Stuart & Julie A. Jackson are applying for a variance from Section 70-113(b) of the City Code of Ordinances to allow a building to be moved from inside the city to a location inside the city. Sec. 70-113. License and permit required. (b) Inside to outside only. Permits may be issued only for moving buildings from inside the city to outside the city. Mr. Stuart's request is based on saving "Old Stock Housing". Their original plan was to demolish this structure along with the detached garage and then rebuild a new single family dwelling at a later date. Section 18-20 of the City Code of Ordinances requires that the BSC consider the following in considering a variance request: Mandatory factors. In considering a variance, the BSC shall take the following into account: (1) Whether the applicant has made an earnest, good faith effort to comply with the requirement. (2) Whether the applicant brought the matter to the attention of the city on his own motion, without intervention or enforcement action by any city official. (3) Whether alternative methods or procedures will achieve the same, or substantially the same, result as literal compliance with the requirement. Required findings. The BSC may not issue a variance unless it affirmatively finds all of the following: (1) The imposition of the requirement imposes an exceptional hardship upon the applicant. It is the general intent of this section that financial cost, alone, would not ordinarily constitute an exceptional hardship. (2) No reasonable and feasible method or procedure is currently available to comply with the requirement. (3) The imposition of the requirement is unjustified because of good and sufficient cause demonstrated to the BSC. (4) The variance will not introduce or increase any threat to public health or safety. (5) The variance is consistent with the purpose and intent of the ordinance in question. I • 0 (6) The variance will not cause a nuisance and will not unreasonably interfere with the use of nearby property. (7) The variance will not cause a fraud to be worked upon the public or any individual. (8) The variance will not cause an increase in public expenditures or budgets. (9) The variance will not create an irreconcilable conflict with any other ordinance, law, rule or regulation. (2) Chad & Marlena Terrell are requesting a variance from Section 70-116(d) of the City Code of Ordinances to allow a building to be moved with a central peak higher than 17.5 feet. Sec. 70-116. Establishment of times, routes, etc. (d) Maximum sizes. In no event may the height of a loaded building exceed 14.5 feet (except that a central peak may extend to a height not to exceed 17.5 feet), nor may the width exceed 30 feet. The building official may impose smaller size limits, especially to minimize disruption to trees, public facilities, use of the street areas or other activities or facilities. Height and width are determined by measuring the building as loaded on the equipment, including any vehicle, braces or wheels that may be used for the move. At the time of writing this Staff Summery Chad & Marlena Terrell had not determined the actual central peak height of the structure while loaded on the moving equipment. The existing structure, though sound, is too small and of antiquated design for my family. Following Hurricaine Ike I became aware that a young couple, the Terrell's (6522 Community), had suffered catastrophic wind and water damage during the storm. This damage was much worse than it otherwise might have been as Mr. Terrell, a community fireman, was called out during the storm for firefighting duty. Thus, he was unable to make temporary repairs to his property that might have mitigated further damage and flooding loss. We would like to donate this structure to the Terrell's and are requesting a variance from Section 70-113b which appears to prohibit the moving of structures within the city. Specifically, we are requesting a one time variance to move the structure at 4144 Oberlin to the location at 6522 Community. We are agreeable to various stipulations such as clearing the lot,etc_ Of note, this home is an excellent example of old stock housing that would allow the city to further it's goal of preserving historical homes while maintaining the city tax base and allowing a nice young couple in public service jobs to continue to live in the area. The property at 6522 Community is 47 feet wide, and as such is unbuildable according to current city codes. If the current structure is removed, the tax base of the city will be diminished considerably as the value of the land will essentially be zero; with a nicely reconditioned bungalow moved onto the site the community tax base will be preserved. The TerreWs will address issues pertaining to their property (front elevation, garage location, etc) however I firmly believe that with a little flexability this would make a nice project; the commissioners are invited to the bungalow for a visit inside if they wish As an aside, the city really should require prominent notice be provided to buyers of undevelopable properties during closing at the title company, if not before. Stuart Jackson October 15, 2008 City of West University Place Zoning Board of Adjustment Dear Sir or Madam: On September 13d, our home was severely damaged by Hurricane Ike. Up to 6 inches of floodwater entered leaving behind damaged floors, moldy walls, and ruined furniture. We had broken windows caused by flying debris. Falling branches and uprooted trees structurally compromised our roof causing leaks and water damage. We filed an insurance claim Sept 13, 2008 (as of Oct 15, 2008 they still have not been to our home) and applied to FEMA and for an SBA loan. Our SBA loan- denied. FEMA has come out, but is still waiting on our insurance company. The damage is extensive: We need to replace the roof; drywall, baseboards, lower kitchen cabinets, laminate floors, windows, hardwood floors, appliances, dining furniture, cabinets, and refinish antique furniture that belonged to my grandparents. Attempting repairs on our own, we had a slab repair company come out to ask about raising and fixing the foundation. We were told work could not be done on our home because when the house was built in 1945 our foundation was poured with no reinforcement:. Over time, the slab has broken into many pieces. No amount of posts could bring it up and any pressure would break it even more. In addition, our home has sunk 1 inch below ground level. Now every time it rains, our yard floods and wader seeps in from the slab. You can actually see water coming up in the cracks. We have mold beginning to show through the drywall and paint. We clean with bleach often and currently have two ion air purifiers and 5 fans running 24 hrs a day in our house. We thought that rebuilding would be our only option, but after the SBA denial, we have found ourselves in a very difficult situation. With every rain, it gets worse.. . This is where our variance request comes in.. . The Jackson family has offered us a beautiful, 1940's, structurally sound, old stock West L. bungalow as a donation. This 2/1 house is on pier and beam and measures approximately 1010 square feet:. It has been updated electric:ally, has beautiful refinished hardwoods, and has no interior or exterior problems. Everything about this home is sound. Built with cypress, there is not an ounce of wood rots All we have to do is move it few blocks, a total distance of 0.2 miles! Currently West University allows buildings to be moved oirt of the city. We ask that we are allowed to move within. The home measures 26.9' making it easy to move down the street. The height is approximately 17 ft., yet may require a variance depending on the height of the moving truck. The 3-block move contains no streetlights and minimal power lines. The trees are mostly clear from the street, and due to the pitch on the roof, it would allow for minimal to no damage. -2- October 15, 2008 Our current residence will he donated to the West University Fire Dept (my husband is a firefighter) prior to demolition for vertical ventilation and primary/secondary search and rescue training Once our current structure has been removed, we will be leveling the foundation, adding new drainage systems to prevent further flooding, and adding a two-car garage. In conclusion, this is the perfect opportunity to protect and preserve West University's old stock housing, to give West U Fire Dept a house for training, and provide us a safe home to live in. The purpose of the hearing is to provide an opportunity for all persons to be heard in relation to the following matter: Address of the site: 4149 Oberlin & 6522 Community Legal Description of the Site: LT 2 & TR 1A BLK 29 (LT 2 & E 10 FT OF LT 1) Colonial Terrace Sec C; LT 22 BILK 36 Colonial Terrace Docket No.: 08-05 Applicant: James Stuart & Julie A. Jackson Chad & Marlena Terrell (1) A variance from Section 70-113(b) of the City's Code of Ordinances, to allow a building to be moved from one site inside the City to another site inside the City (i.e., from 4149 Oberlin to 6522 Community). (2) A variance from Section 70- 116(d) of the City's Code or Ordinances, to allow a building to be moved with a central peak higher than 17.5 feet.
