HomeMy WebLinkAbout05012003 BSC Minutes City of West ~ University Place A Neighborhood City ® Recycled Paper Building & Standards Commission Municipal Building, Bill Watson Conference Room 3800 UNIVERSITY BOULEVARD Meeting Minutes May Ist, 2003 MEMBERS PRESENT: James McDaniel, David Kehn, Les Albin, Darryl Friday, and Patrick O'Donnell, Jorge Jimenez-Marcos and Muddy McDaniel MEMBERS ABSENT: Bryant Slimp and James T. Collier COUNCIL LIASION: Danny Jackson (Absent) STAFF PRESENT: Dennis Mack, Annette Arriaga 1. Call to Order. With a quorum, present James McDaniel called the meeting to order at 6:00 p.m. 2. Citizens who wish to be heard. None. 3. Citizens who wish to address agenda items. None. 4. Designation of voting members. James McDaniel stated per the alternate voting schedule that Jorge Jimenez-Marcos is the first voting member and Muddy McDaniel is voting second for the meeting. 5. Meeting Minutes. James McDaniel made a motion to approve meeting minutes as amended from the April 3`d, 2003 BSC meeting. Les Albin seconds the motion. AYES: James McDaniel, Les Albin, David Kehn, Patrick O'Donnell and Jorge Jimenez-Marcos. NOES: None. ABSTAIN: Motion passed minutes approved. 6. Variance Request. Per James McDaniel item tabled until due to the applicant being out of town. Item tabled unit the next scheduled BSC meeting. Les Albin motioned first to approve. Muddy McDaniel seconds the motion. AYES: James McDaniel, Les Albin, David Kehn, Patrick O'Donnell, and Jorge Jimenez- Marcos. NOES: None. ABSTAIN: Motion passes item tabled. 7. Special Session. James McDaniel stated to BSC, whether or not to grant a special session. If there was justification or a compelling reason for granting a special session. James McDaniel added that if BSC agrees then BSC will decide when the special session will be held. Les Albin added that this is not for our board. That this is a Zoning and Planning issue. Dennis Mack stated that under Chapter 6. gives the building official the authority to change the address. The applicant applies with Harris County Appraisal District. The district checks with 911 services. Once the application is approved the applicant drops off the paper work with the building official. Dennis Mack forwards it to the finance department to process and approve the address change. Jeanie Eymontt a resident at 3019 Pittsburgh St. stated the house was built in 1931. By a Charles P. Jones. The lot . faced Vanderbilt St according to the 1931 original plat. This is not a rotated lot. Although, 3030 Pittsburgh St. The original building always faced Pittsburgh. The residents in the 3000 and 6400 & 6500 block of Pittsburgh St. and Belmont St. feel strongly against the address change. They feel the building official made a quick decision in changing the address. This is a rotated corner lot. Dennis Mack added that the address change has nothing to do with setbacks. Mr. Jerry Seals a resident at 3015 Pittsburgh St. asked if all the proper procedures were followed. Mr. Michael Walsh a resident at 3007 Pittsburgh St. stated that the permit was issued under 3030 Pittsburgh St. not 6447 Vanderbilt St. and that it shouldn't have been changed. The building permit is marked clearly 3030 Pittsburgh St. Sam Ioannidis a resident at 3024 Pittsburgh St. stated that there is a fence that is being placed 5 feet from the property line. Those walking such as small children, posses as a potential danger. The fence is an 8- foot concrete stucco fence that faces Pittsburgh St. Mr. Sam Ioannidis also indicated that Pittsburgh St. is a very busy area and is concerned about safety in general. David Kelm asked if changing the address would change anything. Dennis Mack stated that changing the address would not have any effect. Les Albin also stated that the address change does not have any bearing on the issues. Jorge Jimenez- Marcos motioned first to not grant a Special Session of the Building and Standards Commission. James McDaniel seconds the motion. AYES: James McDaniel, Les Albin, David Kelm, Patrick O'Donnell and Jorge Jimenez-Marcos, NOES: Muddy McDaniel ABSTAIN: To not grant a Special Session of the Building and Standards Commission. 8. Framed Area. Jorge Jimenez-Marcos was going to discuss framed area in more detail but found out that framed area was discussed and it was voted down by City Council. Ordinance is keep as is. Per, James McDaniel, framed area is to be taken off next month's agenda. 9. Fences. Jorge Jimenez-Marcos stated that he wanted to request a survey before a fence is to be built. Dennis Mack added that West University city inspectors are only looking at the set backs of the fence and not determining the property lines. James McDaniel stated the issue is the fence builder to get a survey. The surveyor would physically verify the property lines and he will certify • and guarantee his survey. Dennis Mack stated that all documents would be recorded and the city would keep records of any changes. David Kehn stated that either an agreement between the neighbors on a shared fence or they would have to do the survey. Jorge Jimenez-Marcos stated that he is requesting a survey of the lot indicating the property line before a fence is put up. A pre and post survey. Dennis Mack stated that the post survey accomplishes the same thing. It verifies the property lines as well as the fence location. The resident would not have to pay for both surveys to be done. Jorge Jimenez-Marcos stated that before any one demolishes they will have to notify the neighbors. James McDaniel stated that a post construction survey is a good idea. Survey's or an agreement between neighbors is a good idea. Patrick O'Donnell stated that under Section 6.585. Property Lines, he wanted to add the property owner. BSC members approved the change. Sec.6.582. Property Lines. It shall be the responsibility of the property owner who constructs a fence, or causes it to be constructed, to locate the fence within the property lines. Sec.6.584. Distance from Property Line; Common Fences. A boundary fence shall be constructed immediately along the property line or as close as practicable to the property line. (Common fences may be constructed along the property line, if the written consent of the owners of both properties is submitted or a pre survey.) Sec.6.586. Removal of Debris. It shall be the responsibility of the permit holder/property owner who constructs a fence, or causes it to be done, to clean up and remove from the premises all debris, dirt, scrap and broken pieces of concrete caused by the construction of the fence. • Jorge Jimenez-Marcos stated that he wanted to discuss Section 6.588 Facing of Fences. Jorge Jimenez-Marcos stated that the fences that faces the street represent the city and that the fences should be maintained, look nice and complimentary to the house. It would be a visual effect for the city. Jorge Jimenez-Marcos gave an example of a house on the corner of Brompton and Cason. Building and Standards Commission Minutes May 1", 2003 Page 3 of 3 • The design of the house was stucco with a stucco fence. The house matched the fence and looks really nice. Patrick O'Donnell disagreed and stated, if residents have a brick house would that mean that they would have to have a brick fence. James McDaniel agreed, trying to regulate the architectural design would be hard. There are so many criteria's that would be involved. (No changes) Sec.6.585. Easements. No brick, masonry or similar type of fence may be constructed, improved or structurally altered if it would interfere with the installation and maintenance of utility lines in any easement reserved therefore. Sec.6.588. Facing of Fences. All fences abutting on a street area shall be constructed so that all supporting members, including posts and horizontal runners, shall not face he street. This provision shall apply to such portions of a fence that faces the street on which the lot faces as well as a side street. Sec.6.593. Maintenance. Any person owning or controlling a fence shall maintain it in good repair so as not to endanger any person or property. 10. July Meetine Date. BSC agreed that the July meeting be held on Tuesday, July 15`, 2003. Jorge Jimenez-Marcos motioned first to approve. David Kelm seconds the motion. AYES: Les Albin, • David Kelm, James McDaniel, and Jorge-Jimenez Marcos. NOES: None. ABSTAIN: Motion passed. 11. Commission Member Comments Les Albin is requesting again from staff information on rot resistant materials. David Kehn wanted to know more information about the building permitting process. 12. Staff Comments. Dennis Mack is requesting to exempt the city from Section.6.590. Electricity, Barbed Wire Prohibited. Dennis Mack to possibly put up a stand of barbed wire at one of the City's water plants. 13. Adiournment. Les Albin moved first to adjourn. David Kehn seconds the motion.
