Meeting Minutes
September 4th, 2003
MEMBERS PRESENT: James McDaniel, Les Albin, Darryl Friday, Jorge Jimenez-Marcos, and
Patrick O'Donnell
MEMBERS ABSENT: Bryant Slimp, David Kehn, James T. Collier and Muddy McDaniel
COUNCIL LIASION: (None)
STAFF PRESENT: Annette Arriaga, Daniel Paripovich and Dennis Mack
Jim Dougherty (City Attorney arrived at 6:43 P.M.)
1. Call to Order. With a quorum, present James McDaniel called the meeting to order at 6:03 P.M.
2. Citizens who wish to be heard. None.
3. Citizens who wish to address agenda items Mr. Charles Mc Murry stated that his father owns a
home in West University Place at 4240 Bryan St. Mr. Charles Mc Murry's father has since passed
away but, still owns property in West University Place. Mr. Charles Mc Murry is aware of the very
poor condition of the house at 6428 Community Drive. He wants the city to do everything in its
power and to too immediately address all the problems and to secure windows and doors and to put
• up a fence around the entire site. Mr. Charles Mc Murry also stated that the house is obviously
opened and abandoned, full of rubbish, a haven for rats and a fire hazard. Mr. Charles Mc Murry
wants the city to advise staff to intervene and immediately take care of the problems that have
festered for over a decade. Mr. Charles Mc Murry added that he has a financial interest in
marketing the property at 4240 Byron Street and would like to see the property cleaned and cleared
up. Mrs. Barbara Carlson a resident at 3130 Albans and who owns property at 6324 Community
Drive stated that she would also like to see the lot cleared and removed because of all the safety
reasons. Mr. Mike Soper a resident at 6432 Community Drive also a resident would like to see the
property cleared.
4. Designation of voting members. James McDaniel stated per the alternate voting schedule that
Patrick O'Donnell, Darryl Friday and Jorge Jimenez-Marcos are the voting members for the
meeting.
5. Meeting Minutes. Darryl Friday made a motion first to approve meeting minutes from the August
7th, 2003 BSC meeting. Jorge Jimenez-Marcos seconds the motion. AYES: James McDaniel, Les
Albin, Darryl Friday, Jorge Jimenez- Marcos, and Patrick O'Donnell. NOES: None. ABSTAIN:
Motion passed. Minutes approved.
6. Variance Request. Applicant Mr. Gregory S. and Angela M. Ethier where not present. No motion
made.
7. 6428 Community Drive. Daniel Paripovich stated that the lot at 6428 Community Drive is unsafe,
unsanitary, a breeding ground for animals, the site it self impacts the neighbors. Daniel Paripovich
• stated that the file on this house is large and goes back numerous years. Dennis Mack added that if
the city can foreclose on the house, we will. However, there are several liens on the house and the
city is seeking legal council to make sure everything is followed properly. Daniel Paripovich stated
that numerous letters have been sent by register mail and all letters come back undelivered. A legal

notice was posted in the newspaper. All efforts where made to contact this owner at 6428
Community Drive.
• • Identify Parties: Building Official, Dennis Mack. Code Enforcement Officer/Animal Control
Officer, Daniel Paripovich.
• Other Parties. Not Present
• Oath. James McDaniel stated that BSC would act as a Quasi-judicial proceeding. There will be
some process to go through first. Identify parties. Building Official Dennis Mack and Code
Enforcement Officer/Animal Control Officer Daniel Paripovich. Both, parties took the oath from
James McDaniel.
• Data and Support. Visual exhibits and all documented records and files.
• Additional Questions. James Mc Daniel asked if Dennis Mack had any additional questions to ask
the board. Per, Dennis Mack there were no further questions.
James McDaniel questioned what type of time frame? Dennis Mack stated that they are looking at,
as fast as they possibly can. Darryl Friday, expressed his extreme caution when the house is
demolished, considering the nature of the mold that house may have.
Jim Dougherty, City Attorney for West University Place stated that he had a few additional
questions that needed to be answered. A form of questions and to make sure there were no
objections to this list.
Finding of fact
Notice of the hearing required by Subchapter C, Chapter 54 of the Texas Local Government Code.
Property contains a one-story, frame house and garage.
Square Feet: 1405 sq feet
Estimated cost of the new building will exceed the cost of repair.
• Estimated cost of repair: $140,000.000
Estimated cost of a new building/similar size and type: $112,000.00
Estimated cost to remove/demolish: $3,500.00
Owner of the property and the subject building: Leonard C. Harris, Jr.
Optional Item: Access a civil order. BSC stated no penalties would be added.
Jim Dougherty stated the he will work up the order and there will be a thirty day wait period.
Les Albin motion first, to approve. Motion for Building Official to take all necessary and
appropriate actions to demolish and remove the house. Darryl Friday seconds the motion. AYES:
Les Albin, James McDaniel, Darryl Friday, Jorge Jimenez-Marcos and Patrick O'Donnell. NOES:
None. ABSTAIN: Motion passed.
8. Fences. James McDaniel stated and asked BSC if the revised fence draft met their final approval.
If the final draft is approved then it will go to council. Jorge Jimenez-Marcos asked about the
survey that was discussed? Dennis Mack stated that they survey is included. The new site plan will
require a survey that will show the fence. It will be referred to as a, as built survey. Darryl Friday
asked about, proper notification? Dennis Mack stated that proper notification to the neighbors can
be done and we can mail the notifications to the residents. James Mc Daniel stated if this could be
done at an administrative procedure? Dennis Mack stated that the form can be drafted up at the
administrative level and sent to residents two weeks before construction of a fence. Darryl Friday
stated that he would like to see this as an administrative function or to put it as part of our current
ordinance. James McDaniel stated that in Chapter 6 Sec 6.404. Contractor's disclosure to
neighbors. James Mc Daniel stated that BSC could also draft some form of language in Subchapter
• I. Fences, regarding notification. James Mc Daniel stated that it would be O.K. to add notifications
and Dennis Mack agreed. James McDaniel motioned first to add the disclosures in Chapter 6
Sec.6.404. Contractors disclose to neighbors. Darryl Friday seconds the motion. AYES: James

ABSTAIN: James McDaniel abstains. Motion to include disclosure to neighbors.
Darryl Friday stated that he would like to make a motion to make this a final draft and to be
adopted and to send this to City Council. Darryl Friday motions first. James McDaniel seconds the
motion.
Les Albin stated that he would like to un-strike Subchapter I. Fences Sec.6.581 Maximum height
limits. ( c ) Height Measurement. Les Albin stated that he would like this as originally written.
James McDaniel stated to restore this paragraph. Les Albin motion first to strike revisions and
other wise adopt subparagraph ( c Patrick O'Donnell seconds the motion. AYES: James
McDaniel, Les Albin, and Patrick O'Donnell NOES: Darryl Friday and Jorge Jimenez- Marcos.
9. Framing Requirements. Les Albin stated that on framing requirements if double 2x4's could be
used in lieu of 3x4's. Dennis Mack stated that using double 2X4's would be expectable if we could
get an engineer to guarantee and certify it. Dennis Mack stated that older homes that are two story.
The homeowners want to add a third floor. The home at that time was built and designed for a two
residence. To maintain the structural strength of the third floor. The engineer would have to certify
it on a set a plans. The plans would have to be approved and it would have to pass all necessary
inspections. Les Albin stated that the issue of 3X4's keeps coming up. Dennis Mack added that as
many cases that BSC have seen, that the committee should look at this on a case by case. Les Albin
indicated that all engineers state that double 2X4's are equivalent to 3X4's. James McDaniel stated
that BSC has the authority to say yes or no. We may refuse or except the information from the
engineers. BSC aren't required to except to except the evidence. Dennis Mack stated that the
framing requirements would require load calculations. James McDaniel stated that the frame
requirements would be brought back to the next BSC meeting for review and discussion. No
• motion made.
10. Fire Rated and Rot Resistant Materials. Les Albin stated that the AWPA codes discuss and
define certain types of woods that are considered treated materials. All material is defined. In the
International Building Codes it does address rotten materials. James McDaniel stated that this
would be brought back to the next BSC meeting for review. No motion made.
11. Staff Comments and Status Reports. None.
12. Commission Member Comments.
• Darryl Friday would like the status of the PVC pipe.
• Discussed framing.
13. Adiournment. Patrick O'Donnell moved first to adjourn. Les Albin seconds the motion. AYES:
James McDaniel, Les Albin, Darryl Friday, Jorge Jimenez-Marcus and Patrick O'Donnell. NOES:
None. Motion passed. Meeting adjourned at 8:05 P.M.
