MEMBERS PRESENT: Bryant Slimp, John Ayres, Darryl Friday and J. Denis Powers (Arrived at
2:15 p.m.)
MEMBERS ABSENT: David Flame, Dr. Peter Benjamin, J. Denis Powers, Brian Hoogendam,
Muddy McDaniel and Kevin McMahon.
COUNCIL LIASION: (Absent).
STAFF PRESENT: Annette Arriaga, Dennis Mack and Ron Wicker.
GUESTS PRESENT: Elan Tavor, Julio L. Laguiarta and Mike Talianchich.
[Call to Order.] With a quorum, present Bryant Slimp called the meeting to order at 2:00 p.m.
1. Foundations. Bryant Slimp went over the order of proceedings for the public hearing and
introduced the BSC committee and staff. Bryant Slimp went over the power point presentation and
current proposed draft amendment of the Standard Codes Schedule regarding foundations with
revisions through October 7`h, 2004. Bryant Slimp continued to discuss the proposed foundation
code changes. He went over the background, problems, BSC studies, design criteria and goals. He
went over the proposed code amendments. Bryant Slimp asked for the first speaker to address the
;commission.
❑ Request to speak during the public hearing: Mr. Michael L. Talianchich P.E. stated that he
is a resident of West University and he is also starting a new construction project in West
University Place. He addresses the Errors and Omissions insurance requirements as stated
in the proposed code amendments. Draft amendment of the Standard Codes Schedule
regarding foundations, with revisions through 10-7-04. Mr. Michael L. Talianchich, wanted
to know why the commission was requiring all of this insurance? It may be difficult for him
to get errors and omission insurance. He is an engineer and is acting as his own general
contractor and builder. He has made several calls and is currently having trouble trying to
get the errors and omissions insurance coverage. If he does end up accruing the insurance
coverage, he is wondering what it will cost him to have it. Mr. Michael L. Talianchich
continued to discuss the different types of foundations that he has designed and built and
that he has never had a problem. He also discussed how each pier hole could with stand so
many pounds. He has built eleven houses with the same type of system and experienced no
failures. He also discussed the definition of the RLPE and the RLGE and that they needed
to be revised. He suggested that the P.E., who stamps and signs the drawings and provided
the stamped and signed designed calculations, is the only individual who should be
responsible. Mr. Michael L. Talianchich wanted to also inform the board, that as a good
engineer he doesn't need to be told how to do engineering. He stated he has sent
documentation to the state and is inquiring if what the commission is doing is ethical.
Bryant Slimp thanked Mr. Michael L. Talianchich and stated that he would take into
consideration all of his input.

Motion by John Ayres: I move that all statements, exhibits and documents be made part of the
official record of this hearing and that this hearing be formally adjourned. Darryl Friday seconds
the motion to adjourn. AYES: Bryant Slimp, Darryl Friday and John Ayres. NOES: None.
ABSTAIN: Motion passed. Meeting adjourned.
