Meeting Minutes
February 2, 2006

[Call to Order] Bryant Slimp called the meeting to order at 6:06 p.m.
1. Notices, Rules, Etc. Bryant Slimp stated that Dave Miller would be the
alternate voting member for the meeting.
• 2. Meeting Minutes. Dr. Peter Benjamin made a motion to approve the meeting
minutes as amended from the December 1, 2005 Building and Standards
Commission meeting. David Flame seconded the motion. AYES: Bryant
Slimp, David Flame, Dr. Peter Benjamin, J. Denis Powers, Dave Miller,
Michael Talianchich and Muddy McDaniel. NOES: None. ABSTAIN: None.
Motion passed. Meeting minutes approved. J. Denis Powers made a motion to
approve the meeting minutes as amended from the January 11, 2006 Building
and Standards Commission meeting. David Flame seconded the motion.
AYES: Bryant Slimp, David Flame, Dr. Peter Benjamin, J. Denis Powers,
Dave Miller, Michael Talianchich and Muddy McDaniel. NOES: None.
ABSTAIN: None. Motion passed. Meeting minutes approved
3. Animal Registration Revocation Hearing. Dr. Peter Benjamin made a
motion to suspend the Building and Standards Commission meeting to have
the hearing. J. Denis Powers seconded the motion. AYES: Bryant Slimp,
David Flame, Dr. Peter Benjamin, J. Denis Powers, Dave Miller, Michael
Talianchich and Muddy McDaniel. NOES: None. ABSTAIN: None. Motion
Passed. Bryant Slimp explained the Rules of Procedures and Quasi Judicial
review. Bryant Slimp swore in each witness. Bryant asked for a brief report
from City Staff. Debbie Scarcella introduced Daniel Paripovich, Code
Enforcement and Animal Control Officer. Daniel gave a brief summary
• stating there were multiple attempts to try to get the barking dog under control
- which all failed that lead to the revocation of the animal registration. Mr.

Eggleston, 6403 Sewanee, stated they have two dogs, one is 10 years old and
is blind; the other one is four years old. The Eggleston put bark collars on the
dogs and also put them in the house as much as possible. Mr. Eggleston stated
that he used to be contacted when the neighbors had a problem with their
barking dogs, but now the Police Department gets the phone calls. The
Eggleston's received letters from a couple of their neighbors stating the dogs
do bark from time to time, but they do not bother them. One time the dogs
were barking, there was an intruder in the back of one of the neighbors yard.
Peggy Eggleston stated that she thinks that the problem the Difranco's have is
with the older dog. She would like for the board to consider reinstating the
registration for the younger dog. Erin Eggleston read the letters from neighbor
Rose Proler at 6409 Sewanee stating that she did not have any problems with
the dogs and she understood that dogs do bark from time to time. Erin
Eggleston also read a letter from Mr. & Mrs. Lepon at 6355 Sewanee. They
did not disturb the peace. Daniel Paripovich stated that he made numerous
phone calls to the Eggleston's to try getting the matter resolved. He also sent
them certified letters. Daniel stated the incident with the intruder was not
counted toward the number of complaints filed against the Eggleston's and
was not used as a factor in suspending the animal registration. Victor Difranco
at 6412 Westchester stated that he and his wife have been having problems
with the barking dogs for nine years. The dogs would bark constantly all night
long resulting in them having to sleep in different rooms in the house. Mr.
• Difranco stated that it was only in the last several years that they decided to
call the police department when the barking became really bad. Numerous
citations were issued, but Difranco's withdrew their complaints with promises
that the barking would not continue. Mrs. Difranco recalled one weekend
where the barking continued from sun down to sun up while the Eggleston's
were away enjoying their weekend. Mrs. Difranco thought she was going to
have a nervous breakdown that weekend. Eric Eggleston drew a sketch to
illustrate the location of the resident's that submitted a little to the
Eggleston's. Mr. Eggleston stated that the Difranco's are retired and are more
acceptable to the barking. The Difranco's stated the dogs are usually put
inside at sun down. Daniel Paripovich stated that he asked the Eggleston's
different methods to keep the dogs from barking. Either bark-collars, keeping
them inside to obedience training. The Eggleston's stated the bark collars did
not work. Bryant Slimp stated the hearing is now closed and BSC meeting is
now back in order. Michael Talianchich made a motion to the Animal
Control's decision to revoke animal registration and to allow petitioner to
come and reappear at the February 2007 meeting or later to request
reinstatement of the registration at that written time a written order be
prepared for signature by the Chairman. J. Denis Powers seconded the motion.
AYES: Bryant Slimp, David Flame, J. Denis Powers, Dave Miller, Michael
Talianchich and Muddy McDaniel. NOES: None. ABSTAIN: None. Motion
passed.

4. Technical Code Schedule Amendments. Alvin Collins, Fire Marshall, stated
that what he is asking the BSC to do is to consider adopting the 2003 Addition
of the International Fire Code along with Amendment Item #7 on Page S4.
Alvin Collins read the amendment and the changes that needed to be made to
be consistent with the Building and Residential Code. Alvin stated that the
way the code reads now without the amendment; only the commercial
buildings would have to abide by the Code. The size of address numbers was
also discussed and where they needed to be placed at the residence or
commercial building. Dave Miller made a motion to approve the proposed
changes to the International Codes as presented in the amended Technical
Codes Schedule and support staff in presenting the proposed amendments to
City Council for review and possible adoption. J. Denis Powers seconded the
motion. AYES: Bryant Slimp, David Flame, J. Denis Powers, Dave Miller,
Michael Talianchich and Muddy McDaniel. NOES: None. ABSTAIN: None.
Motion passed.
5. Structural. Bryant stated that the amendments to the structural ordinance are
about ready to go before City Council for their approval. There was a
workshop meeting held on Monday, January 30, 2006 where the Board made
some changes. All changes have been made with the exception regarding the
metric change. Bryant Slimp asked if the framing certificate should go along
with the ordinance. James Dougherty stated the outline for the certification is
in the ordinance, but the actual outline is delegated to the Building Official. J.
Denis Powers made a motion to approve the proposed changes to the
structural framing section of the Technical Codes Schedule and support staff
in presenting the proposed amendments to City Council for review and
possible adoption. Michael Talianchich seconded the motion. AYES: Bryant
Slimp, David Flame, J. Denis Powers, Dave Miller, Michael Talianchich and
Muddy McDaniel. NOES: None. ABSTAIN: None. Motion passed.
6. Flood Prevention and Protection. Debbie Scarcella briefly discussed some
of the changes that have been made to the ordinance. J. Denis Powers asked if
there was anything in the ordinance that BSC needed input from Mike
Vanderwater with Claunch and Miller. Debbie Scarcella stated there has been
discussion to have Claunch and Miller at any workshop meeting. Michael
Talianchich made a motion to request a joint workshop with members of City
Council and the Zoning and Planning Commission for the purpose of
discussing the proposed draft of the flood Prevention and Protection ordinance
amendments. Dave Miller seconded the motion. AYES: Bryant Slimp, David
Flame, J. Denis Powers, Dave Miller, Michael Talianchich and Muddy
McDaniel. NOES: None. ABSTAIN: None. Motion passed.
[Adjournment] Dave Miller made a motion to adjourn. Michael Talianchich
seconded the motion. AYES: Bryant Slimp, David Flame, Dr. Peter Benjamin, J.
