AN ORDINANCE AMENDING ORDINANCE NO. 1896 RELATING TO THE
EFFECTIVE DATE OF APPENDIX P OF THE INTERNATIONAL
RESIDENTIAL CODE, 2006 EDITION, AS ADOPTED BY THE CITY OF
WEST UNIVERSITY PLACE, TEXAS, AND CONTAINING FINDINGS AND
PROVISIONS RELATING TO THE SUBJECT.
WHEREAS, the City Council of the City of West University Place, Texas has
previously adopted Ordinance No. 1896, which ordinance, among other things, included
the adoption of the International Residential Code, 2006 Edition, with its appendices, as
a Technical Code of the City of West University Place, Texas; and
WHEREAS, Appendix P of the International Residential Code requires automatic
fire sprinkler systems for residential structures; and
WHEREAS, the City Council of the City of West University Place, Texas has
determined that the effective date of Appendix P of the International Residential Code,
2006 Edition, should be delayed as a result of legislation recently enacted by the Texas
Legislature.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST UNIVERSITY PLACE, TEXAS THAT:
Section 1. Ordinance No. 1896 previously adopted by the City Council of the
City of West University Place, Texas is hereby amended to revise the effective date for
Appendix P of the International Residential Code, 2006 Edition, to September 1, 2009.
Section 2. All other provisions of Ordinance No. 1896 not specifically amended
hereby remain in full force and effect.
Section 3. All ordinances and parts of ordinances in conflict with this Ordinance
are repealed to the extent of the conflict only.
Section 4. If any word, phrase, clause, sentence, paragraph, section or other
part of this Ordinance or the application thereof to any person or circumstance, shall
ever be held to be invalid or unconstitutional by any court of competent jurisdiction,
neither the remainder of this Ordinance, nor the application of such word, phrase,
clause, sentence, paragraph, section or other part of this Ordinance to any other person
or circumstances, shall be affected hereby.
Section 5. The City Council of the City of West University Place, Texas officially
finds, determines and declares that a sufficient written notice of the date, hour, place
and subject of the meeting at which this Ordinance was discussed, considered or acted
upon was given in the manner required by the Texas Open Meetings Act, as amended,
and that such meeting has been open to the public as required by law at all times during
such discussion, consideration and action. The City Council ratifies, approves and
confirms such notices and the contents and posting thereof.
Section 6. This Ordinance shall take effect immediately upon its passage and
adoption.
Section 7. The City Council of the City of West University Place, Texas officially
finds, determines and declares that an emergency and urgent public necessity exists
because of the public importance of this measure and the requirements of law. Such
emergency requires passage of this Ordinance on first and final reading.
