I " ,.. 4.,-0,Q , .L ~1 D ORDINANCE NUMBER 1277 u AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE SPECIAL ELECTION HELD JANUARY 17, 1987, AND CONTAINING RELATED " 'FINDINGS AND PROVISIONS. WHEREAS, the City Council of the 'City of West University Place, Tex,as, (the "City"), ordained that an election be held in the City on the 17th day of January, 1987, for the purpose of electing one Council Member of said City to fill the unexpired term of former Council Member James W. Cummings; WHEREAS; 'the returns'"of sllch election have been duly and legally made and submitted to the City Council of the City for canvassing, and a tabulation of the returns for each election precinct and for absentee voting, as canvassed and tabulated by the City Council of the "City and shown in Exhibit A attached hereto, reflect that the sum of precinct totals for each candidate as follows: J.B. Thompson G. Lynwood Howard Counc il Member 193 votes Council Member 89 'votes NOW, THEREFORE, '01, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, THAT: Section 1. All of the recitals contained in the preamble of this Ordinance are found to be true and are adopted as findings of fact by this City Council and as part of its judgment, particularly the results of the election described therein as canvassed and tabulated in the preamble hereof and as shown in, and made a part hereof for all purposes, Exhibit A attached hereto. Section 2. As a result of such canvass and tabulation it is hereby determined that J. B. Thompson, with a total of 193 votes cast for him, was elected Council Member of the City of West University Place, Texas. Section 3. The City Secretary is hereby authorized and directed to make the appropriate entries of information appearing in the tabulation of precinct results shown in Exhibit A attached hereto in the election register maintained by the City in accordance with provisions of Section 67.006 of the TEXAS ELECTION CODE. Section 4. If any word, phrase, clause, sentence, paragraph, section or other part of this ordinance or the application thereof to any person or circumstance, shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, the remainder of this ordinance and the application of such word, phrase, clause, sentence, paragraph, section or other part of this ordinance to any other persons or circumstances shall not be affected thereby. I ' u 1~~ is 9 [l Section 5. All ordinances and parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. Section 6. The City Council officially finds, determines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this ordinance was discussed, considered or acted upon was given in the manner required by the Open Meetings Law, TEX. REV. CIV. STAT. ANN. art. 6252-17, as amended, and that each such meeting has been open to the public as required by law at all, times during such discussion, consideration and action. The City Council ratifies, approves and confirms such notices and the contents and posting thereof. Section 7. The public importance of this measure and the requirements of the law create an emergency and an urgent public necessity requir~ng that this Ordinance be passed and take effect as an emergency measur~, and a state of emergency is hereby declared, and this Ordinance is accordingly passed as an emergency measure and shall take effect and be in force immediately from and after its passage.
