CITY COUNCIL REGULAR SESSION
MONDAY, MARCH 13,2000
MUNICIPAL BUILDING COUNCIL CHAMBERS

The City Council convened in Regular Session in the Municipal Building Council
Chambers on March 13, 2000, with the following members present: Mayor Lewis
presiding, Council Members Ballanfant, Bertini, Grubb and May. The City Manager,
AssistantCity Secretary, City Attorney, Police Chief and Public Works Director were
also present.
The notice for this meeting was posted inaccordance with the Texas Government Code,
Chapter 551, on the 10th day of March 2000 at 12:30 p.m.
Public Hearin!!:.
A Public. Hearing was held before the Zoning arid Planning Commission and the City
Council of the City of West University Place, Texas. The purpose for the hearing was to
provide an opportunity for parties in interest and citizens to be heard in relation to a
proposed Comprehensive Plan for the City.
Members of the Zoning and Planning Commission present at the meeting were: Chair
Charles Nelson, Vice-Chair Marilyn Griffin, Karol Musher, Larry Kelly, Marc Boucher,
Bob Higley and Stephen Pohl.
The public hearing was called to order by Mayor Lewis and Mr. Nelson at 7:35 p.m.
In order to ensure understanding of the proposed comprehensive plan, Mr. Pohl read
through the plan, while providing explanatory comments on various items.
Members of the public were invited to ask questions or speak concerning the proposed
plan.
H. T. Englehardt, 2802 Lafayette, felt the comprehensive plan was one-sided. Cultural
environment should be considered along with the physical environment. He opposed
Article IX, Section 9.01.
Sid Glasscock, 4020 Oberlin, stated that he was a member of the West University Church
of Christ. He stated that he felt the plan was vague, contradicting and insulting. He
opposed Section 9.01.
Sam Clark, 3407 Bissonnet, stated that he wanted to relinquish his time to Dick Reese.

Dick Reese, 3407 Bissonnet, stated that he was an attorney representing the West U
Church of Christ. He stated that he felt the comprehensive plan was discriminating. He
opposed Section 9.01
John Butler, 4119 Oberlin, stated that he was a member of the West U Methodist Church.
He commented that he also took issue with Section 9.01. He asked the City Council to
table consideration of the ordinance until the language could be agreed upon.
Craig Ward, 3906 Marlowe, commented that he was a member of the West U Baptist
Church. He stated that while he supported the need to maintain a traditional residential
community he found the language in the plan currently incompatible with the cultures
and values of the community as a whole. He stated that the language is not general but
specific.
Ralph Abercia, 314 Gentilly Place, stated that he was a member of St. George Orthodox
Church and thanked the commission for their work on the comprehensive plan. He
opposed Section 9.01. He asked the Commission to revisit the plan and delete some of
the language.
Ralph Arnold, 12731 Westella, stated that he attended the West U Church of Christ and
that he supported the comments of the four previous speakers.
Steve Brown, 3305 Rice Blvd, made several suggestions to revise the sections relating to
lighting, environment, sidewalks and town center.
Bob Park, 3752 Plumb, commented that West U had an election a year ago and a lot of it
related to planning. He stated that the Commission should be commended for their work
and that the comprehensive plan picked up the spirit of the election which was that West
U should be maintained as a family oriented place.
Joe Foster, 4125 Coleridge, thanked the Commission for their work. He suggested that a
citizen task force be set up to develop and recommend measures dealing with achievable
and practical environmental issues.
Mr. Glasscock asked that new language be added to do something about replacing and
repairing sidewalks.
Tim Hansen, 3131 Robinhood, addressed drainage and the section on environment.
Marilyn Griffm, a member of the Commission, commented that she wanted to go on
record as saying that she also felt the language in Section 9.01(b) was not good.
There being no other residents wishing to speak on the proposed comprehensive plan, the
public hearing closed at 8:32 p.m.

Ordinance desimatin!!: one-way street se!!:ments.
Matters related to the fIrst andfmal reading of Ordinance No. 1638.
Mayor Lewis read the caption of Ordinance No. 1638 as follows:
An ordinance designating one-way street segments for a temporary trial period;
containing findings and other provisions relating to the subject; and declaring an
emergency
Copies of Ordinance No. 1638, in the form proposed for adoption, were available in the
Council Chambers.
Police Chief Kevin Begley reported that the TraffIc Task Force has recommended that
Judson Street be designated as a one-way street from the point where it intersects with
South Judson west bound to Community Street and South Judson be designated as a one-
way street where it intersects with Community east bound to Judson Street.
A motion was made by Council Member Bertini, seconded by Council Member May, to
adopt Ordinance No. 1638 as introduced by the Mayor and spoken of by Chief Begley.
City Attorney Jim Dougherty recommended that Ordinance No. 1638 be amended to add
the standard emergency language.
The amendment was accepted.

Ordinance relatine: to a municipal consent for telecommunications facilities.
Matters related to the fIrst reading Ordinance No. 1640.
Mayor Lewis read the caption of Ordinance No. 1640 as follows:
An ordinance approving and authorizing a municipal consent and construction permit for
certain telecommunication facilities; and containing [mdings and provisions related to the
subj ect.
Copies of Ordinance No. 1640, in the form proposed for adoption, were available in the
Council Chambers.
Public Works Director Ed Menville reported that AT&T Local Services has requested
permission to install 65 feet of underground conduit in Academy Street. The conduit
would be located just west of the existing curb line and north of Cason Street. The
conduit enables them to run their communication cable underground from an existing
overhead pole position to a vault in the Academy right-of-way.
The municipal consent provides for a non-refundable application fee of $850.00 plus a
construction plan review fee of $100.00. The right-of-way fee would be $13.00
quarterly.
A motion was made by Council Member Grubb, seconded by Council Member
Ballanfant, to adopt Ordinance No. 1640 on the first reading.

28, 2000.
A motion was made by Council Member May, seconded by Council Member Grubb, to
approve the minutes as presented.

Staff report.
City Manager Sherman Yehl reported that the oath of office would be administered to the
two officers who recently joined the police force on Thursday, March 16th at 3:30.
Everyone is invited to attend.
Council comments:
Council Member May commented that one of the City's building inspectors has made
some great suggestions on preparing drawings for building inspections. He also
commented that the Comprehensive Plan should be studied further especially relating to
environmental issues and lighting.
Council Member Bertini commented that the Recycling and Solid Waste Reduction
Board might also be interested in participating in concepts related to environment. The
Traffic Task Force has been addressing issues relating to the Whole Foods Market and
the Edloe Street Linear Park. Additionally, old signage has been removed and new signs
put in their place.
Mayor Lewis stated that the comments made regarding the Comprehensive Plan were
valuable and that the plan is in the right hands which is the Zoning and Planning
Commission. She also commented that the Home Place Celebration is scheduled to begin
on April 1 st .
The City Council recessed the Regular Session at 8:50 p.m.
The Regular Session reconvened at 9:15 p.m.

A motion was made by Council Member Grubb, seconded by Council Member
Ballanfant, to table Ordinance No. 1641 relating to the Comprehensive Plan.

With no further business to come before the City Council at this time, a motion was made
by Council Member Ballanfant, seconded by Council Member May, to adjourn. The
Regular Session adjourned at 9:16 p.m.
